Falmouth Taxpayers Burdened Wind Turbine Litigation Costs

Local & State officials demand taxpayers continue paying massive litigation costs for the torturous Falmouth wind turbines.
It’s time for the Falmouth Town Meeting Members and taxpayers of Falmouth to ask : “Who Are The Friends Of Falmouth Wind “
The Friends of Falmouth Wind # 1 is a secret group of so called residents in Falmouth . The truth be told the group is a group of former past and present local -state officials. The group is fighting the so called war on fossil fuels at the cost of Falmouth residents health, property rights and now taxpayers resources.
Falmouth, Massachusetts is ground zero for the poor placement of commercial wind turbines in the United States.
The Massachusetts Clean Energy Center the former owners of the ill fated wind turbines has admitted it placed the wind turbines Ad Hoc in 2010.
It’s clear from prior Massachusetts Clean Energy studies in 2005 that they had always known about two distinct types of noise referenced in the Mattapoisett feasibility study. The noise was described as (1) regulatory and (2) human annoyance or today what is called infra-sound.
The Town of Falmouth released a letter dated August 3, 2010 through the Freedom of Information Act that all those involved in the installation of Falmouth Wind 1 were aware of the noise problems.
The only conclusion that can be drawn is the Town of Falmouth did not get a Special Permit to build the Falmouth wind turbine because it would have required noise studies and setback regulations.
The Friends of Falmouth Wind want to appeal the recent Massachusetts Supreme Court ruling in order to make the state renewable energy goal of 2000 megawatts of renewable energy by the year 2020.
The Friends of Falmouth Wind have taken up a petition to have you the taxpayers of Falmouth continue years of litigation.
The Town of Falmouth never got a Special Permit for the Falmouth Wind 1 turbine. The Cape Cod Commission Model Bylaws require a Special Permit. The Falmouth town bylaws require a Special Permit. The wind turbine study done and paid for by the Massachusetts Clean Energy Center said it needed a Special Permit.

Urge Falmouth Selectmen to support wind turbine operation & MSJC appeal

Mar 10, 2015 — Falmouth Selectmen need encouragement to support continued operation of the Town’s two wind turbines. As you may know, an appellate court recently ruled the Town should’ve obtained a special permit before building Wind1. Selectmen are deciding whether or not to appeal this unexpected decision, which overturned both the Building Commissioner and a 2013 Barnstable Superior Court ruling.
The recent spike in electricity rates means the turbines now generate about 30% more revenue for the Town. This revenue benefits the entire town, and can also be used for mitigation of the few impacted homes.
Falmouth Residents - please contact the selectmen to remind them of your support for Falmouth’s turbines, and to urge them to file the appeal in MA Supreme Judicial Court.See address and message template below.

Subject: Support Town’s Wind Turbines
Dear Falmouth Board of Selectmen,
I’m contacting you to urge the Board to continue supporting operation of the Town’s wind turbines, and to appeal the recent appellate court decision regarding Wind1. The turbines generate clean energy and badly needed revenue for the Town. This revenue can be used to mitigate impacts at affected homes, and for many other purposes. In May 2013, a two to one majority of Falmouth voters rejected funding turbine removal. The recent 30% spike in electricity rates not only makes the turbines more valuable, it highlights our economic vulnerability due to reliance on fossil fuels. Please go ahead with the appeal to MSJC. The cost to appeal to the MSJC is low whereas the cost to the Town of not doing so could be very high.
