Falmouth Wind Turbines One Year Later

Falmouth Zoning Board of Appeals voted in September of 2015 to shut down one of the town’s twin wind turbines after six years of legal battles by neighbors.

The board voted 4-1 to issue a cease-and-desist order on wind turbine number 1, which the Massachusetts Court of Appeals ruled in June 2015 had been erected without proper zoning approval. The court stopped short of ordering the turbine shut down, however, leaving that matter a question for local authorities to tackle.

The Town of Falmouth also hid an August 2010 noise warning letter from the manufacturer of the turbine it generates dangerously loud noise.

Vestas the manufacturer of the V-82 turbine warned the turbine is twice as loud as a General Electric wind turbine used in Falmouth wind noise studies.

During the permitting process for Falmouth Wind turbine number 2 the town kept the warning letter secret.

The acting town manager at that time misdirected elected town officials over the permit process for Falmouth Wind II.

Selectman David Braga, a former Falmouth police officer was ill informed about the permit process for the wind turbines. Acting Town Manager Heather Harper had told Selectman David Braga in 2011 selectmen did not have jurisdiction over the permit.

The town claims after hiding the letter and misdirecting public officials over the permit process the residents around the turbines no longer have the right to appeal the permit process.

Massachusetts politicians at the state and local levels have been convicted of counts of felony criminal activity including attempted improper influence of a public official.
