Falmouth Wind Turbine By-Law Broken

Bylaws : protect the public health, safety, environment and general welfare of citizens

Bylaws are enacted and folowed to protect the public health, safety, environment and general welfare of citizens by establishing rules, regulations and laws.

The Town of Falmouth ignored these two bylaws below to install two commercial megawatt turbines.

Falmouth is known world wide as ground zero for poorly sited wind turbines in the United States.

Town officials, Vestas wind company and associated contractors were aware prior to the installation of the turbines that the noise from the wind turbines would disregard the public health, safety, environment and general health of the residents living around the wind turbines.

Following bylaw 240-166 the wind turbine bylaw would have resulted in further studies and setback issues in which the turbines would never have been built .

The Town of Falmouth was made aware that the turbines could reach a decibel level as high as 110 prior to the installations. A lawn mower is 107 decibels, power saw 110 decibels ,snowmobile and motorcycles 100 !

§ 240-18Classification of uses.

Where an activity might be classified under more than one of the following uses, the more specific classification shall govern; if equally specific, the more restrictive shall govern. Uses not classifiable under any category listed for the applicable district are prohibited, except that a use listed nowhere in Articles Vthrough XIII may be allowed on special permit if the Board of Appeals determines that it closely resembles in its neighborhood impacts a use allowed or allowed on special permit in that district.

240-166Purpose; special permits; prohibitions; definitions; application requirements; review; decision; conditions.

A. Purpose: The purposes of this bylaw are: to accommodate wind energy systems as accessory land uses to supplement the power used by residents, municipal government bodies and businesses; and to provide standards for the placement, design, construction, monitoring, modification and removal of wind energy systems through a special permitting process based on the procedures, provisions and requirements established herein.
