MassCEC seeks to help the town recover costs associated with related litigation

Falmouth Gets Wind Turbine Litigation Fees Paid For By MassCEC

Falmouth Selectwoman Mary Pat Flynn chairman of the board did not attend the meeting due to a car accident ten days ago. It was reported she has trouble walking. There were no reports in the local media.

Under Administrative Orders the board approved a two part wind turbine agreement with the Massachusetts Clean Energy Center. The agreement lets the Town of Falmouth off the hook for future curtailment of the wind turbines due to ongoing Massachusetts Superior Court litigation and other pending litigation. ( lined up out the door)

The SelectBoard also authorized the town manager to execute a plan offered and approved at last years town meeting. The Massachusetts Clean Energy Center will contribute $500,000 to the reserve account and the town contibuted $300,000 to the same account. The deal awards the town up to $85,000.00 annually for a total of 1.8 million.

Quote from MassCEC web site last year :

“The Massachusetts Clean Energy Center (MassCEC) Board of Directors today approved up to $1.8 million in relief funds for the Town of Falmouth to help the municipality mitigate the financial impacts associated with the reduced operations of its town-owned wind turbine project located at the Town of Falmouth Wastewater Treatment Plant.
With this funding, MassCEC seeks to help the town recover costs associated with project curtailment. To date the town has incurred unexpected costs resulting from community concerns, voluntary reductions in operation due to unanticipated sound levels and related litigation.”

Note # 1 It should be noted that the quote from the MassCEC designates relief funds to the Town of Falmouth for litigation. At this time it appears the Massachusetts Clean Energy Center is helping to pay the litigation fees of the town. The only conclusion at this time that can be drawn is the MassCEC is not helping pay the litigation costs of victims of the wind turbines.


This puts the semi quasi state agency in a precarious position of paying the litigation fees of the litigants that they favor in all future litigation cases. The MassCEC and town have set a new legal precedence using renewable energy funds for litigation costs .
