Falmouth WIND1 Ordered Shutdown

By a 4-1 vote, Falmouth’s Zoning Board of Appeals tonight over-turned the Building Commissioner’s ‘cease & desist’ denial.

Wind 1 will cease operations immediately and until the determination of the Special Permit process by the ZBA scheduled to begin Oct 29.

As it happened tonight, petitioners argued for equal rights and protections afforded by MGL and local Bylaw.

Harm alleged centered on a use violation, in existence for 5+ years, that aggrieves petitioner’s health and welfare.

The Town (Wind1 owner/operator) argued that it’s harm would (future) result in municipal economic distress.The Town’s forecasted harm did not rise to the level of equivalent severity experienced by petitioners.

A sense of basic values and an attention to justice, on this night, won out over $$$ ~
