The MassCEC has made themselves judge and jury paying wind turbine litigation fees for the town while ignoring the wind turbine victims fees and creating an atmosphere of giving the town Carte blanche to continue filing frivolous lawsuit appeals against the wind turbine victims in an effort to outspend the victims

Falmouth Article 11 Tonight Helps Pays Town Litigation Not Wind Victims

The Town of Falmouth is spending tens of thousands a year on wind turbine litigation. The MassCEC is helping the Town of Falmouth pay its litigation fees with taxpayers renewable energy money.

Falmouth will vote tonight to replenish a one million dollar fund that has used a large portion to finance legal fees to fight the wind turbine victims who have lost their health and property rights in Falmouth.

No matter how you cut it litigation fees have been used from the one million dollar fund

The Massachusetts Clean Energy Center is not paying the wind turbine victims litigation fees victimizing the residential home owners who have lost their health and property rights again.

The victims are having their own taxes used against them by the MassCEC

The MassCEC needs judicial oversight from the courts. The payment of litigation fees by a state agency to only one side in any lawsuit sets a dangerous precedence in the so called war on fossil fuels.

Falmouth just lost a major lawsuit in Massachusetts Superior Court against the wind turbine victims. The town again has appealed that case. The MassCEC states they will fund “related litigation.”

A legal remedy for the Massachusetts Supreme Court is to have the Town of Falmouth pay the litigation fees of the wind turbine victims for the town filing
frivolous lawsuit appeals at the Massachusetts Superior Court.

The MassCEC appears to be circumventing the MSC, Massachusetts Superior Court. The wind turbine victims have no financial benefactors.

Here is a portion of a press release from the Mass CEC stating they will pay for the Town of Falmouth litigation fees :

“With this funding, MassCEC seeks to help the town recover costs associated with project curtailment. To date the town has incurred unexpected costs resulting from community concerns, voluntary reductions in operation due to unanticipated sound levels and related litigation.”
