Posted: Thursday, July 16, 2015

Judge Rufo took no action because he saw no need to act before the Falmouth Zoning Board of Appeals has had a chance to rewrite the findings of the permit appeal, in accordance with the Superior Judicial Court decision.

It is now the responsibility of the ZBA to act in a manner consistent with the Superior Judicial Court, which found that the Town of Falmouth was not exempt from its turbine bylaw.
