Town and State Officials Guilty Rico Violations Wind Turbines

Officials Hid Noise Warning Letters, Memos, Videos, Misrepresented Noise Studies, Hurt People, Took Property For A Wind Turbine Agenda

Falmouth Wind Turbines & Rico Act

Passed in 1970, the Racketeer Influenced and Corrupt Organizations Act (RICO) is a federal law designed to combat organized crime in the United States. It allows prosecution and civil penalties for racketeering activity performed as part of an ongoing criminal enterprise.

To convict a defendant under RICO, the government must prove that the defendant engaged in two or more instances of racketeering activity and that the defendant directly invested in, maintained an interest in, or participated in a criminal enterprise affecting interstate or foreign commerce.

For twenty-one years, from 1975-1984 and from 1991-2002, Vincent A. “Buddy” Cianci was the mayor of Providence, Rhode Island.

Ultimately, Cianci was only convicted of one RICO conspiracy count.
The First Circuit notes—for a RICO conspiracy conviction, a defendant simply “must intend to further an endeavor which, if completed, would satisfy all of the elements of a substantive criminal offense, but it suffices that he adopted the goal of furthering or facilitating the criminal endeavor.”

Buddy Cianci was therefore found guilty of a §1962(d) RICO conspiracy violation and sentenced to five years and four months in prison.


The Installation of the Falmouth wind turbines was a “criminal enterprise” working to keep two town owned wind turbines operating despite the pain and suffering and health affects of residential home owners.

Before, during and after the wind turbine installations in Falmouth local and state officials committed criminal acts under the RICO Racketeer Influenced and Corrupt Organizations Act and the Hobbs Act .

A . Falmouth Community Wind Project Site Screening Report Apr 19, 2005. This report was prepared by KEMA ECOLOGY AND ENVIRONMENT, INC. and funded by the Massachusetts Technology Collaborative aka today the Massachusetts Clean Energy Center.

The report says a Special permit is needed to build Falmouth Wind 1

B. Massachusetts Technology Collaborative aka today the Massachusetts Clean Energy Center were the owners of the politically embarrassing Vestas V 82 megawatt wind turbines being held in storage at $3500.00 per month that couldn’t be sold at auction.
( Massachusetts Technology Collaborative aka today the Massachusetts Clean Energy Center advances 1 million dollars to the Town of Falmouth to buy Falmouth Wind 1 ) A bribe using taxpayer funds

C. General Electric a domestic wind turbine company would not build megawatt turbines in Falmouth over set back issues. Falmouth uses 6 million in ARRA,
American Recovery and Reinvestment Act of 2009, files a waiver request for a second foreign made Vestas V-82 commercial wind turbine larger than the GE turbine.The question of was the 6 million a loan or a grant has never been answered.

D. Massachusetts Technology Collaborative aka today the Massachusetts Clean Energy Center fails to do a detailed acoustic analysis based upon sampling of ambient acoustic conditions - ( addmission April 2, 2013 memo to Town of Falmouth ) .Wind test results were
extrapolated to look below state noise guidelines.

E. MTC aka MassCEC drops reference to two distinct types of sound for Falmouth wind study. Two types of sounds quoted in previous studies “state regulatory” and “human annoyance.” MTC wind turbine officials had been aware of human annoyance study in a Boone, North Carolina. The Federal Government Wind Noise Study was 1979.

F. Vestas Wind Company warns town turbine can generate 110 decibels almost double the manufactured specifications of 103.5 decibels ( recent Freedom of Information Act Request letter dated August 3, 2010

G. Town considers Special wind turbine bylaw 240-166 which would require additional notification to abutters and additional noise tests. Town avoids special permit 240-166

H. April 2010 Falmouth Wind 1 begins operation - Noise complaints begin.

I. Town of Falmouth with the previous knowledge and facts already stated makes people who complain about noise file elaborate written certified noise complaints. A process is developed to design the complaint forms and the stall begins. Local and state officials all along were aware of the noise issues.

J. A local group called the Friends of Falmouth Wind is formed to keep the turbines operating despite noise complaints. The group is made up of current and past Falmouth officials.

K. MTC aka MassCEC contracts the Consensus Building Institute ( CBI ) to engage in an open, transparent meetings to resolve noise problems. The process is called the Falmouth Wind Turbine Option Analysis Process ( WTOP ). The process includes showing all the meetings on Falmouth Cable TV. The cost to taxpayers is $388,000.00. The Town of Falmouth withholds various documents. The resolution becomes a dog & pony show for the public.

L. A member of Friends of Falmouth Wind tapes the September 12, 2012 WTOP-CBI meeting about the use of federal stimulus funds. The tape becomes “Lost .” The public is never told of the missing tape. The tape has the question over the 6 million dollar loan or a grant for Falmouth Wind II.

M. The Massachussetts Clean Energy Center provides Falmouth 1.8 million.
“With this funding, MassCEC seeks to help the town recover costs associated with project curtailment. To date the town has incurred unexpected costs resulting from community concerns, voluntary reductions in operation due to unanticipated sound levels and related litigation.”

The town uses the funds to pay its litigation fees

The MTC aka MassCEC is paying the town litigation fees -not the victims fees.The MTC aka MassCEC victimizes the abutters again. The hope is to outspend the victims in court and bankrupt them using taxpayer funds.
