Massachusetts Zoning Board Of Appeals - July 23, 2015 6:30 P.M.
Attorney Christopher Senie, on behalf of a ll the families he represents, has filed an appeal of Eladio Gore’s decision to give the town 30 days to file for a special permit for the wind turbines.
The time has arrived for the town’s litigation team to stop playing patty cake in the knife fight that characterizes the town’s struggle to maintain operation of the wind turbines and shut down permanently the loud turbines described as torture.
Town counsel has allowed Christopher Senie to argue in court for years with almost no cross examination or rebutting evidence because all the evidence is against the town.
For starters, considerable such material is already in the public domain.
A. The Town was aware the turbines generate 110 decibels of noise almost twice the specifications ( they knew prior to installation)

Dear Mr. Potamis, The Town has previously been provided with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances.

B. The Massachusetts Clean Energy Center the former owners of Falmouth Wind 1 are playing CYA in an April 2013 memo to the Town of Falmouth they knew the turbines were too loud. An admission of guilt:

“Falmouth Wind 1 was one of the earliest municipally-owned megawatt scale wind turbines installed in Massachusetts. Even though the original MTC-commissioned feasibility study for Falmouth over-estimated the likely acoustic impact, that study did not include a detailed acoustic analysis based upon sampling of ambient acoustic conditions (as is our current, more rigorous practice) which might have identified a potential exceedance of the 10 decibel limit,” the memo reads. “The Falmouth wind turbines are of an older design which does not offer ‘low noise operations’ or other retrofit options.”

C. Massachusetts Clean Energy Center ,Nils Bolgen, Director of Wind Energy admits setback mistakes 2013
“Nills Bolgen, who works with the Massachusetts Clean Energy Center , said his organization has become “more conservative” in requiring project proposals seeking funding to provide more detailed data if they are close to residential areas.”
“In 2005, when the Center began requiring applicants to provide acoustical data, Bolgen said it was done on an “ad hoc” basis.”
“Now, all turbine proposals within 2,000 feet of residences must provide that data.”

Thus the contest about the wind turbines has reached an absurd point with the wind turbine victims being made into a villain and the town boards into white knights. It is time to fish right or cut bait.
It is time to stop what is hoped to be an effective litigation team that has been in place more than a year. It is time for town counsel to withdraw and stop wasting taxpayer funds.
The Falmouth town litigation team is being financed by 1.8 million in taxpayer funds to help in related litigation costs by the Massachusetts Clean Energy Center in an effort to outspend the wind turbine victims. Your neighbors.
Your tax dollars are going to the MassCEC and then being passed out to law firms to stab the residents of Falmouth in the back in this ongoing knife fight financed by the MassCEC who sold you the turbines in the first place
