North Attleboro Tow Truck Driver Found Innocent of Drunk Driving in Foxborough

Thursday, Joseph P. Abellan​, 58, was found innocent in Wrentham District Court of his second drunken driving offense.

Foxborough, MA — A North Attleboro tow truck driver has been found not guilty of driving drunk while in Foxborough.

Thursday, Joseph P. Abellan, 58, was found innocent in Wrentham District Court of his second drunken driving offense and driving to endanger, according to the Sun Chronicle.

According to the Foxborough Police Log, police responded to a damaged tow truck on East Belcher Street during the early hours of December 13, 2014. On the scene, police reported fresh damage to the truck on the front driver side, the hubcap appeared as if it was almost ripped off and the front bumper on the driver side was pushed in with tree limbs sticking out of it.

Abellan said he had two glasses of wine and suffered a head injury earlier in the evening.

Judge Stephen Ostrach noted in his decision that there was no break-alcohol test, no sobriety test, and the prosecution could not beet its burden of proof beyond a reasonable doubt.
