Prosecutors Say Robert Kraft's Lawyers Lied In Court
According to prosecutors, Kraft's attorneys Alex Spiro and William Burck asked a question based off evidence they lied about having.

FOXBOROUGH, MA — Prosecutors filed a motion Tuesday to have two of Robert Kraft's lawyers held in contempt of court after accusing them of lying during his prostitution case. According to prosecutors, attorneys Alex Spiro and William Burck asked a question based off evidence they lied about having during a May 1 hearing regarding the suppression of video evidence related to accusations Kraft twice solicited prostitution at Orchids of Asia Day Spa in Jupiter, Florida, USA Today reported.
The request was based off the defense's examination of Jupiter police officer Scott Kimbark, who stopped many of the two dozen men who faced prostitution charges following the sting at the massage parlor. Kimbark was the officer who identified Kraft leaving the spa on Jan. 19, according to prosecutors. When questioning Scott Kimbark, a police officer, Kraft's attorneys argued police never had probable cause to stop Kraft and asked him if ever mentioned fabricating cause to do so. According to Kraft's attorney's Kimbark's statement was picked up on body camera.
"Did you say, jokingly or not, that you would, 'make some [expletive] up?" Spiro asked Kimbark.

But prosecutors in their court filing wrote that Kimbark's reported remarks were never picked up by body camera, and Kraft's attorney's knowlingly asked the police officer question based off a "false statement of fact." Burck told USA Today the prosecution's accusations are false and he plans to submit evidence that Kimbark made the remark.
Kraft has pleaded not guilty to two counts of soliciting prostitution. He is accused of visiting the spa twice while it was under video surveillance. One of those visits was the day of the AFC Championship game, prosecutors said. Kraft's attorneys and prosecutos have argued over whether the surveillance videos should be released to the public.

Two weeks ago, Judge Leonard Hanser ruled the videos cannot be released until a jury is sworn in or unless the case was concluded in other ways. Hanser agreed with Kraft's attorneys that it would be nearly impossible for Kraft to receive a fair trial if the videos were released.
Prosecutors said they needed to release the videos because they were also part of a case against the owner and manager at Orchids of Asia Day Spa in Jupiter. Spa manager Lei Wang and owner Hua Zhang pleaded not guilty to maintaining a house of prostitution and numerous other charges. Prosecutors have also cited Florida's "Public Records Act," arguing they are obligated by state law to release the videos.
Kraft is scheduled to appear in court on May 21.
