
In memo of a decision handed down on June 15, Judge Lauriat granted the defendants’ motions to dismiss all 39 counts in the action TH Claims, LLC v Charles J. Cristello et al.
TH Claims, a successor to Thomas J. Hastings, Hingham Square Townhomes LLC, Harbor Dreams LLC, Hingham North Street LLC, Hingham Boat Yard LLC, Back River Land LLC, and Thomas Hastings Properties Inc, filed a $10 million lawsuit on October 28, 2010 against the Town of Hingham, its Board of Selectmen, Planning Board, Building Department and Harbormaster in addition to various volunteer board members both as town officials and individually.
The defendants filed a motion to dismiss the lawsuit. In a 29 page document issued today Judge Peter M. Lauriat allowed the motions to dismiss in their entirety thereby dismissing all Hastings’ claims in this action.

John Riley, Chairman of the Board of Selectmen noted that it is unfortunate that the lawsuit was filed at all. He said that he knows Hastings felt put upon and that Hastings also felt the Town was unfair to him but the Town’s permitting process is very rigorous and every effort is made to keep everyone on a level playing field. Riley believes the court decision reaffirms that. Upon hearing the news, Selectman Burns remarked, “It is nice to be vindicated.”
Selectman Bruce Rabuffo expressed his feelings by saying that he was very happy for the citizens of the town and sorry for all the people who had to go through this. He noted it was time to get on with the important business of the Town.
