Man Convicted Of Biting, Assaulting ICE Officers During Marlborough Arrest Sentenced To Prison
The 24-year-old pleaded guilty in October of last year.
MARLBOROUGH, MA — A violent immigration arrest in Massachusetts last year has led to a Guatemalan man being sentenced to prison.
Guido Andres Cuellar Batres, 24, pleaded guilty to forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers in October 2025, according to the U.S. Attorney's Office. Cuellar was sentenced on Thursday to eight months in prison, followed by one year of supervised release, and is subject to deportation after completing his sentence.
Officials said that Cueller had overstayed his non-immigrant visa by more than four years and that, as a result, an immigration warrant for his arrest was issued.

Shortly before 10 a.m. on May 4, 2025, three ICE officers and one DEA agent set up surveillance in a parking lot in Marlborough. Officers observed a vehicle entering the parking lot, with Cuellar in the front seat, according to officials. The officers approached the vehicle and ordered Cuellar to step out, but he refused, officials said.
Officers then ordered him and the driver to unlock the vehicle, but they refused. That was when officials said Cuellar reached down in a way that officers couldn't see his hands, and were concerned he may be reaching for a weapon.

Officers then broke the rear passenger-side window to enter the vehicle and unlock the front passenger door, according to the USAO.
After being removed from the vehicle, Cuellar resisted officers, the USAO said. He tried to bite one of them in the leg, bit another officer above his wrist, and struck that officer in the head multiple times.
After officers succeeded in handcuffing him, he continued to resist. Officials said he jumped several times to avoid being put in the vehicle. He head-butted an officer who tried to take hold of him and spat directly into his eyes and face, according to USAO.
