Judge Allows Veteran to Keep Formerly Condemned Home
The ruling came from a Worcester Housing Court judge Thursday afternoon.

A months-long battle between the town and an aging veteran came to a conditional close this week.
Judge Diana Horan of the Worcester Housing Court ruled Thursday that David Timpany can keep his home at 5 Tomaso Road as long as it does not return its former state that led to the Board of Health condemning the property according to the Milford Daily News.
Timpany called the decision “permanent probation,” but Horan said the house would be re-inspected only if the exterior showed a zoning violation or if someone calls about the interior.

Last spring, the Board of House condemned Timpany’s home for a multitude of violations. Since then, the plumbing has been fixed, the trash outside has been removed, and the inside is no longer a danger.
If the Board of Health receives another complaint about the home, Timpany will be found in contempt of court and the case will resume where it ended.
