The DA's office says that Herring had arranged to meet with the victim to purchase marijuana. It was further indicated that Herring had entered the victim's car and assaulted the victim as another unknown man wearing a ski mask approached the driver's side door.

Preliminary investigations suggested that the defendant was allegedly attempting to rob the vehicle and used the car to flee. When the victim refused to exit the vehicle, Herring allegedly shot him in the chest.
