LOWELL, MA -- A Wilmington was sentenced to 2.5 years in prison followed by two years probation after accepting a plea deal in Lowell District Court Thursday. Joseph Boidi, 29, had been arrested last June by Tewksbury Police after allegedly firing a gun at another man at the Motel 6 during an argument.

In October, a grand jury indicted Boidi on charges of assault with a dangerous weapon, attempted assault and battery with a firearm, possession of a firearm without a license, possession of a loaded firearm, and witness intimidation. Leah Donovan, 30, of Wildrose Drive in Dracut, who was arrested at the same time as Boidi, was not on the list of grand jury indictments released Tuesday.

According to the Lowell Sun, which first reported this story, prosecutors dismissed charges after Boidi agreed to plead guilty to to carrying a firearm without a license, possession of a firearm without an FID, and intimidation of a witness.

Police responded to a shots fired call at the Motel on June 5. When they arrived, they found a shell casing and viewed surveillance video that showed Boidi and Donovan arguing with a man. Police said the video showed Boidi drawing a .22 caliber pistol, which was later found in his car, and firing the weapon.

Donovan, who was arrested for assault and battery on a police officer, misleading a police officer, resisting arrest, and two warrants for shoplifting and larceny, allegedly gave police a false name when questioned and kicked one of the arresting police detectives.
