Parents Sued MA Over Removal Of Their 2 Boys, And Lawsuit May Advance: Report

There was no judicial authorization for state workers to take the children, the parents say.

WALTHAM, MA — After having to turn over their children to state workers in the middle of the night, a pair of Waltham parents decided to fight back legally. Now they may have their day in court.

Josh Sabey and Sarah Perkins sued staff at the Massachusetts Department of Children and Families over the removal of their two young boys in July 2022, according to a report by WBTS-TV 10.

A doctor treating the parents’ 4-month-old for a fever suspected he might be a victim of child abuse, prompting DCF workers and police to show up at 1 a.m. to take both boys as a precaution.

But there was no judicial approval for the removal. And a DCF investigation found no evidence of abuse or neglect, Sabey and Perkins said in their legal complaint.

Some of the officials and police named as defendants were qualified as immune and removed from the lawsuit. But now a federal judge has ruled it can proceed against two high-ranking DCF staff.
