Fatal Westford Bicyclist Crash: Driver Cleared

LINCOLN, MA — A driver involved in a fatal bicycle collision in Lincoln last year that killed a Westford man has been cleared of any wrongdoing, state officials announced Tuesday. Mark Himelfarb, 59, of Westford, died following the crash on August 17, 2016. The collision happened on Virginia Road.

The vehicle involved was a Toyota Highlander sport utility vehicle. The identity of the driver was not released.

"The investigation, which included a reconstruction of the collision, found that (Himelfarb), while riding his bicycle north on Virginia Road, crossed over the yellow centerline deviating from the marked lanes of northbound travel and encroached upon the motorist’s path of travel," Middlesex District Attorney Marian Ryan and Lincoln police Chief Kevin Kennedy said in a joint statement. "The reconstruction of the scene, which included an analysis of crash debris as well as an examination of tire marks left by the bicycle indicates that the fatal collision occurred in the southbound travel lane. There is no indication that mechanical failure or the operation of another vehicle contributed to this collision."
They continued, "Based on the investigation and all available evidence, no criminal charges or civil motor vehicle infractions will be filed against the operator of the Toyota Highlander."

The collision was investigated by Lincoln police, state police and the Middlesex County District Attorney's Office.
