Legislating gay rights.

Personal rights that all of the citizens of this country cannot be legislated by the electorate.  If that were so you could wake up one day and find the rights you take for granted have been taken away by a majority vote of a very small number of the whole electorate.  Our forefathers put the separation of church and state for a VERY GOOD REASON...
