After failing the eye test, police say the woman sat on the floor and started doing "Tai Chi," doing the splits, and other movements.

A woman has been charged with third degree DWI after allegedly nearly driving into a group of people in a Richfield restaurant parking lot.
On Sept. 1 at 7:08 p.m., a Richfield police officer, identified in the criminal complaint as “Officer Woods,” was dispatched to Fireside Restaurant in Richfield on a report of an intoxicated driver.
The driver, Alynn Neary Mom, 33, of Minneapolis, reportedly struck the curb and almost struck a group of people in the parking lot; the people took the driver's keys, but the driver, Mom, was still trying to get back in her vehicle.

When asked if she consumed alcohol, Mom said "Yes, I' m fine." Mom failed the horizontal gaze nystagmus test. After falling, no walk and turn test was completed.
Mom said she wanted to consult an attorney, and a phone and directories were provided.
Mom made no attempt to call an attorney, police said, and instead, called a friend and her sister, leaving voice mails. She then sat on the floor and started doing "Tai Chi," doing the splits and other movements, according to police.
The Fireside manager provided police with a copy of Mom's drink order receipt, which included a Pinot Grigio wine, a Foundry Blood, and a Ginger 43.
According to police, Mom's 0.28 alcohol concentration is a gross misdemeanor and subjects her to the maximum $12,000 bail.
