Did Tim Huber have a role in his father Delbert's 2011 killing of Albertville resident Tim Larson?

A Kandiyohi County jury is deciding that question at the courthouse in Willmar, according to media reports, after both sides gave closing statements Monday.

The jury called it a day after more than eight hours of deliberations at 10:40 p.m. Monday, according to the West Central Tribune.

Delbert Huber is serving 30 years for the murder of Larson.

The defense portrayed Tim Huber as slow-witted, timid and abused by his domineering father while the Kandiyohi County Attorney tried to convince the jury Huber and his father talked about percieved wrongs that Larson had done them and were afraid Larson planned to kill them on the morning of the shooting. Judge Donald Spilseth gave the jury instructions beginning at 1:47 p.m. He then announced the names of two jurors who were alternates and excused the two men. The jury went into deliberations at around 2:20 p.m.

KDUZ reported:

The prosecution tried to show both Tim and Delbert Huber were angry with Tim Larson, whom they accused of stealing money from them, vandalizing their farm machinery, harrasing them, and was angry at them because the Hubers would not allow him to hunt on their land. ... Delbert Huber used a 105-year-old British military rifle and the medical examiner said Larson died rather quickly of a single bullet wound to the left side of his chest.

The West Central Tribune reported:

The simmering anger, [Kandiyohi County Attorney Jenna] Fischer argued, was refueled when Timothy Larson ordered Timothy Huber and the farm equipment off his father’s place, causing Timothy Huber to tell his father that Larson and his gang were going to do the Hubers in, and that there was money stolen, tractor parts were missing and the tractors were vandalized. ... She also noted that after the shooting, there was no surprise or shock by either Huber, because they knew what was going to happen, that Timothy Larson would be shot and killed that morning.

β€œ(Timothy Huber) was not there when his father decided to kill Timothy Larson,” [defense attorney Stephen] Ferrazzano argued. β€œHe was doing what Norman Larson was depending on him to do, the chores. ... Timothy Huber is acting the way he’s always acted in the face of the things his father had done,” Ferrazzano said. β€œHis whole life, he’s turned and walked away from the evil things his father has done.”
