Alleged Flipped Middle Finger at Ex Leads to Arrest for Pittsfield Man

Concord Police: Richard Marable was arrested twice for domestic violence order violations after approaching his ex and her daughter.

A local man is facing charges after allegedly violating a restraining order twice this month.

Richard L. Marable, 39, of Depot Street in Pittsfield, was arrested at 3:54 p.m. on Sept. 4, 2015, and again at 11:09 a.m. on Sept. 12, for violation of protective order; penalty.

In the first incident, according to an arrest report and court affidavit, officers were sent to the Prescription Center on North Main Street for a report of a potential restraining order violation.

When the officer arrived, he spoke to a woman and a man about the incident. The woman alleged that Marable was allegedly sitting outside of the store when she pulled into the parking lot. He allegedly “raised his middle finger at her” and then she walked into the store to get a prescription for her daughter.

When the woman exited the store about 15 minutes later, Marable was allegedly sitting behind an electrical box on the northern side of the building as she walked toward her parked vehicle. While doing this, an unknown man approached her.

“(The man) asked if they could leave because he was waiting to buy pills from Marable,” the woman alleged. “(A)s this subject was speaking to her, she observed Marable cross Centre St. and stand on the sidewalk just west of the exit to TD Bank which is directly across the street from the Prescription Center.”

The woman took a photo of where Marable had allegedly been sitting and he then reportedly “looked at her, put both arms up by his side and asked her what she was going to do now,” according to the report. A vehicle then appeared, picked him up, and drove away.

The officer looked at the area where Marable was allegedly sitting and it was within the 300 feet of the DVO requirements.

A male witness also confirmed what happened, according to the reports. The officer double-checked the order and later, arrested Marable and he was held without bail.

Eight days later, on Sept. 11, an officer was sent to Warren Street for a report of a possible DVO violation.

A child reported that she was playing with a soccer ball when it rolled away from her and when she went to get it, she allegedly saw Marable peeking around a corner of a building looking at her and another man who was with her, about 10 feet away. Marable allegedly then turned and walked away.

The girl told the officer she knew it was him because he and her mother had dated for a period of time and he allegedly was “very abusive during the relationship.” The man stated that the girl looked she was going to cry so he went over to see what was wrong and allegedly saw Marable walking away toward the Concord Family YMCA.

“(The man) stated that he was 90 percent sure that it was Richard,” according to the court affidavit.

The officer double-checked the restraining order and then issued a warrant for Marable to be arrested.

The next day, Marable was picked up by Pittsfield Police and they met a Concord officer at the Super Shoes in Chichester to transfer custody. He was held without bail.
