At one point, one of the officers asked dispatch if Bennett was a felon. Dispatch, which was running checks on the truck and witnesses, said they did not know but would check. According to scanner chatter, the officer said she found a firearm, but Bennett denied it was his.

The dispatcher said they could not find a CDL license for him, but he had a regular license and was insured.

“It looks like he’s got a little bit of history,” the dispatcher said.

The officer in the field said she had his commercial license in hand. She also ran a check on the 9 mm handgun. The dispatcher later confirmed Bennett had been convicted on drug charges in 2017.

Later, troopers from Troop G, the Motor Carrier Unit investigating issues with commercial vehicles, were requested to the scene. Investigators determined the truck “drifted off the roadway” and “struck an occupied vehicle, which was legally parked,” Amber Lagace, the public information officer for the department, said.

The legally parked car was a Nissan Sentra owned by a recycling and demolition business.

“The crash resulted in the dump truck rolling over and spilling its load onto the roadway,” she said.

The materials from the truck were asphalt.

State police said the firearm was reportedly found inside the truck's cab during the investigation. Bennett was questioned about the gun and later arrested on felony convicted felons-gun possession, driving under the influence, and negligent driving charges.
