Concord Man Allegedly Assaults Woman, Threatens Officer

James Smart reportedly clenched his fist, growled at woman, officer.

A local man was arrested recently for allegedly assaulting a woman and threatening a police officer.

James Douglas Smart, 50, of Tremont Street in Concord, was arrested at 8 p.m. on June 28, and charged with simple assault and criminal threatening.

According to an arrest report and court affidavit, officers were sent to 39 Tremont Street for a report of a domestic disturbance. Upon arrival, the officer spoke to a woman who stated that Smart allegedly “had been drinking all day” and they had been arguing throughout the day.

“(She) said that Smart would ‘black out’ and then ‘come out of it,’” the officer alleged.

Smart would then turn up the music until it was “blaring” and she asked him to turn it down. Smart then allegedly pushed the woman in the stomach and up against a wall. The woman then fled the home and called police, “because she did not want him to black out and assault her again,” the report stated.

The officer went to speak to Smart who was allegedly “visibly intoxicated, and swayed side to side as he stood.” The officer alleged that Smart looked at the woman and “began growling.” He allegedly admitted to drinking and the officer asked him to move to the rear of the residence.

Smart then turned and walked back to the officer, “with his chest pushed out,” and allegedly appeared to be “square up” with the officer.

“Smart began growling, looked at my hand, and clenched his fists,” the officer alleged. “I told him to calm down. Smart kept his fist clenched and continued to growl at me.”

The officer called for back up because he thought Smart might assault him and continued to request that he calm down. Later, he reportedly did, and apologized for what he had done but allegedly denied pushing the woman. He was arrested and refused bail. Smart was arraigned on June 28.
