Concord Man in Trouble Again

Nyabunguye "Eric" Tembasi arrested four times in the last month on trespassing, other charges.

A Congolese national who has been in and out of the Merrimack County House of Corrections during the last year or so on various charges has been arrested four times since Christmas, according to Concord Police arrest reports.

The four incidents stem from a no trespassing order delivered to Nyabunguye “Eric” Tembasi on Christmas Day of 2012, ordering him not to visit family members who previously lived in an apartment on Loudon Road but now live at the Kennedy Apartments on Thompson Street.

In the first incident, on Dec. 26, 2012, officers were called to the building for a report that Tembasi, who is currently homeless, was allegedly violating a no trespass order that was issued the previous day.

Officers reported not finding Tembasi in the building right away.

However, while checking the third floor, an elevator sounded and Tembasi allegedly exited the elevator into the hallway. Tembasi reportedly said he didn’t know he was not allowed back in the building.

Dispatch later confirmed that the paperwork was in effect and had been served to Tembasi. Officers then arrested him and charged him with criminal trespass.

After being arrested, Tembasi allegedly “became agitated and accused me of following him and told me he wasn’t going to deal with me,” the officer wrote. During the booking process, Tembasi was “mumbling things under his breath and randomly laughing,” the officer wrote.

Tembasi refused bail and was arraigned. Dec. 27, 2012.

About two weeks later, at 3:15 p.m. on Jan. 8, Tembasi was arrested again and charged with simple assault (personal weapons), criminal trespass, and default or breach of bail conditions.

According to an arrest report, an officer was dispatched to the apartment building for an alleged fight between Tembasi and his older brother. Based on a previous call, the officer knew that the younger Tembasi had a no trespass order at the building and that he was out on bail. More officers arrived to speak with the elder brother who allegedly stated that Tembasi had just left the apartment.

The brother alleged that when he got home, his brother was in the apartment and was not supposed to be in the building. The brother reportedly asked him how he got into the apartment but Tembasi allegedly didn’t answer.

Tembasi allegedly tried smoking in the apartment and his brother told him to stop. Instead, Tembasi allegedly pushed his brother twice in the chest. The brother called police and Tembasi left.

Tembasi was reportedly seen running on Concord Street and was later found on Lincoln Street and placed under arrest.

While being processed, Tembasi allegedly became “increasingly hostile” to the officer but he was able to complete the process. Tembasi refused to sign any paperwork and was held without bail. He was transferred to the Merrimack County jail and arraigned on Jan. 9.

A few weeks later, Tembasi was arrested again, this time for criminal trespass and default or breach of bail conditions.

At around 6:30 p.m. on Jan. 24, officers were called again to the building concerning allegations that Tembasi was violating a no trespass order. The officers allegedly located him on the third floor just outside his mother’s apartment.

The officers called to him and he reportedly walked over to them. When they asked what he was doing, Tembasi allged said he was visiting his mother. When the officers told him that he was in violation of a no trespass order and was not allowed in the building, he allegedly said that it didn’t matter if they arrested him again, he would just keep coming back. He was then taken into custody and charged. Tembasi refused bail and was transported to jail and arraigned on Jan. 25.

The next day, at around 5 p.m., Tembasi was arrested again and charged with criminal trespass and default or breach of bail conditions.

Officers were called to the building again. According to an arrest report, a sergeant was on patrol in the area and allegedly saw Tembasi in the lobby of the building. Tembasi allegedly stated that he was there to see his mother. He was place under arrest and charged.

During the ride to the police station, the officer alleged that Tembasi continuously warned him that he would not be fingerprinted and to just take him to jail. During booking, he refused bail and was transported to jail. He was arraigned on Jan. 28.
