CRIME LOG: Northwood Man Arrested While Prowling at Penuche’s

The following information was supplied by the Concord Police Department. It does not indicate a conviction.

Benjamin Berry, 37, a homeless man now located in Concord, received a summons at 3:50 p.m. on Feb. 1, on a passing items to or from a motor vehicle ordinance violation. An officer reported seeing a panhandler at the intersection of Loudon Road and Fort Eddy Road. The man, Berry, was holding a sign and the officer began speaking with him, telling him not to step into the road. Dispatch reported that Berry had been warned previously not to step into the roadway. The officer went to Uno’s and about five minutes later, reportedly saw Berry step into the roadway. The officer went back to Berry and issued him a summons. Berry allegedly told the officer that he didn’t know what the officer was talking about but told him that he would continue walking in the roadway to collect money from drivers. The officer told him that if he continued, he would be sent to jail. Berry reportedly stated that he would get three hot meals a day and a bed if he went to jail. The officer again warned him to stop or he would be sent to jail and be a drain on resources in the state of New Hampshire. “Berry said he did not care” and then walked away from the area. “As he walked away he turned and called me a ‘scumbag,’” the officer alleged. “Berry then pulled out cash from the same pocket I had seen him put the items into his pocket. Berry smelled the money, and fanned it in front of himself as he walked down the street. Berry laughed, and continued to smell, and mime that he was counting his money.” Berry had a court date on March 3.

Geoffrey C. Speers, 19, of Weare, received a summons at 12:45 a.m. on Feb. 8, on a driving after revocation or suspension charge. While on Loudon Road near the I-93 overpass, an officer saw a 2005 Ford Focus change lanes without using a signal and then, change lanes again at Fort Eddy Road, without using a signal. The car then stopped at a green light at the Everett Arena where it stood for about five seconds before continuing. The officer followed the vehicle and pulled it over at the First Colebrook Bank location on Loudon Road while another officer arrived to assist. The officer alleged that passengers were moving in the back seat that it later turned out to be a woman putting down her cellphone. Speers, the driver, said they were all using a pool at a local hotel and were going to Wendy’s for food before heading home. A check of Speers’ license revealed that it was suspended on Jan. 2, after a Nov. 26, 2013, conviction for having more than one license. Speers was released with a summons and had a court date on March 10. He was also cited for use of required turn signals and issued a warning for failure to use required turn signals.

Brian J. York, 34, of Northwood, was arrested at 3:56 a.m. on Feb. 8, and charged with prowling and possession of controlled drugs. While on patrol around Central Avenue an officer saw a man allegedly trying to gain access to the main door of Penuche’s Ale House. The officer turned a spotlight on the door and the man moved away from the door. The officer approached the man, later identified as York, and asked him what he was doing, and he allegedly stated, “Nothing.” The officer asked York if he was trying to get into the business and knew if it was closed at that hour and alleged that York “was intoxicated” and had “slurred speech, bloodshot eyes, trouble with balance” and smelled of alcohol. York was arrested. During a search of a backpack that was on the ground near York, the officer allegedly found a bag of marijuana. While this was going on, police spoke to an employee to find out if they were waiting for anyone or knew that York was outside and that person said no. York had a court date on March 10.

Daniel J. McCarthy, 55, of Bedford, received a summons at 12:22 p.m. on Feb. 9, for driving after revocation or suspension and uninspected vehicle. While monitoring traffic at the Lun Hing Motel on Fisherville Road, a 2013 Toyota pass by the officer with an expired yellow September 2013 inspection sticker on the windshield. The officer pulled the vehicle over at the Cumberland Farms. McCarthy reportedly told the officer that he left his Massachusetts license at his sister’s house. The officer stated that he was pulled over for the inspection sticker and McCarthy allegedly stated that the car was his sister’s. A check on McCarthy revealed the Mass. Registry of Motor Vehicles suspended his license on Oct. 29, 2013, for failing to pay child support. McCarthy received summonses and had a court date on March 10.

Alease Moses, 22, of Concord, was arrested at 2:51 pm. on Feb. 10, on a simple assault (personal weapons) charge from Feb. 9, at an apartment on Fisherville Road. Moses turned herself in to police. She’s due in court on March 17.

William Henry Amsler IV, 28, of Concord, was arrested at 6:20 p.m. on Feb. 10, on a simple assault (personal weapons) charge. Officers were called Canton Circle for a domestic in progress with dispatch stating that a man could be heard yelling in the background that the woman would never see her kids again. The woman calling reported that there was a machete in the home and that the man had head-butted her while she was on the phone calling police. As officers arrived, they met with Amsler who allegedly was “visibly agitated and yelling” back at the door of the residence. Amsler was cuffed outside while officers went inside to check on the woman and her three children. The children were not injured but the woman was crying. She stated that she was out at appointments but when she returned around 1:30 p.m., Amsler allegedly began yelling at her about being gone all day and pinned her against a wall. Throughout the day, Amsler was allegedly agitated and then the argument escalated around 5:30 p.m. The woman ordered Amsler to leave the apartment and he allegedly refused and continued yelling. When she threatened to call police, he allegedly stated, “If you call the police your life will be over.” Amsler allegedly pushed her while in the kitchen and injured her wrist. The officer noted a red mark on her wrist, according to the report. Information the dispatcher heard was also noted. Officers then went to speak to Amsler who said he was punched and denied pushing the woman but allegedly admitted that he didn’t want her calling police because he was “not a snitch.” The officer noted no injuries to Amsler and he was arrested.

Tanya LaChance, 33, of Belmont, received a summons at 9:30 a.m. on Feb. 11, on two counts of theft by deception. The charges stem from alleged incident at Walmart on Loudon Road on Sept. 29, and Sept. 30, 2013, involving $49.04 in cash and $68 in store credit. LaChance was being held in the Rockingham County Jail in Brentwood. The officer noted that LaChance was being served a summons since she was accepted into a drug treatment program. She’s due in court on April 7.

Melissa Clark, 44, of Manchester, was arrested at 12:58 p.m. on Feb. 11, on two counts of issuing bad checks and a warrant. The charges stem from alleged incidents at the Concord Food Co-op on South Main Street on July 23, and July 24, 2013. Manchester Police picked up Clark, who was also wanted by Rochester Police on another issuing bad checks charge. She’s due in court on March 17, and March 24.

Christina L. Defosses, 33, of Penacook, was arrested at 6:12 p.m. on Feb. 11, on a criminal mischief (vandalism) charge. The charge stems from an alleged incident on Feb. 10, on Modena Drive involving a glass coffee pot. Defosses turned herself in to police and had a court date on March 10.

James Williams, 38, of Barnstead, was arrested at 10:57 a.m. on Feb. 12, on a criminal mischief (vandalism) charge. The charge stems from an alleged incident at the Hess gas station on Hall Street on Jan. 31, and involves damage done to a 2007 Hyundai Sonata. Williams turned himself in to police. He was released on personal recognizance bail and is due in court on March 24.
