Man Arrested Three Times in One Week

Concord Police: Kristopher Kelley faces assault, protective order violation, and breach charges; alleged people were spying on him.

A local man was arraigned last month on a slew of charges after being arrested three times during the course of a week, according to Concord Police arrest reports and court documents.

Kristopher R. Kelley, 35, of Bog Road in Concord, was arrested at 2:51 p.m. on Sept. 23, and charged with simple assault; he was arrested again on Sept. 26, at 12:28 a.m. for violation of a protective order; penalty, and default or breach of bail conditions; and again at 11:04 a.m. on Sept. 30, on two counts of violation of a protective order; penalty, and default or breach of bail conditions.

According to the first report, police were sent to the River Hill Market on Carter Hill Road to speak to a person about a past tense domestic on Bog Road.

The woman stated that her husband, Kelley, had allegedly hit her in the head and the day before, choked her with a belt.

Police were familiar with issues in the home, including earlier this year. According to the report, Kelley allegedly was “disillusioned” and “reporting people in the trees spying on him” in March. Police found no evidence of people spying on him or being in his apartment.

One officer stayed near the apartment while another officer and a sergeant met with the woman. The sergeant helped the woman put together a formal statement where she alleged that the two had been arguing for about two weeks concerning various issues but only recently had Kelley allegedly become violent and threatened to kill her entire family if he couldn’t have her, according to the report. Earlier in the day, she went to speak to an attorney about filing for a divorce. Later in the day, while arguing again, he allegedly spit at her and struck her in the head with his baseball cap. He also took her cellphone so she had to walk to the store to talk to police.

Police also contacted Kelley who was at work and returned to the apartment and discussed their 20 year relationship and marital issues, including her coming back from a trip and informing him that she wanted him out of their home. He also reportedly complained to officers about past abuse against him and showed marks on his body.

Kelley alleged that his wife threatened “to make up a story to get him arrested.” They spoke about the day and he reportedly denied touching his wife but allegedly admitted to grabbing a hat in an effort to speak with her, since she was yelling and screaming causing a scene. After weighing all the evidence, police arrested Kelley.

Three days later, officers were called to the Bog Road apartment for a report of a restraining order violation with the woman alleging that Kelley had been driving by the home a number of times that day.

At the same time, police caught up with Kelley in his pickup truck on North State Street and asked him to step out to speak with the officers. The reporting officer noted that the truck had luggage and other items in it as if he was living out of the vehicle. He was asked about his travel patterns and reported that he had stayed on Carter Hill Road the previous evening and did drive by his former home, back and forth, on his way to get gas earlier.

Another officer was with the woman who alleged that Kelley drove by the house six times during the day and at around 11 p.m., she heard the truck drive by the home again so she called police. She also reportedly received six text messages from Kelley, a violation of the order. The officer checked her phone and then the other officer on North State Street arrested Kelley. He was held without bail. Since he was out on bail from the previous alleged assault charge, a breach charge was added.

Three days later, on Sept. 29, at around 3 p.m., officers were again called to Bog Road for a report of restraining order violations.

According to a court affidavit, the woman alleged that she received a phone call at around 1:30 p.m. from an unknown number. She answered the phone and the man, who said his name was Tom, asked her to come to a local store quickly about an issue. She thought it might be her boss so she grabbed her kids and went to meet with him and when she arrived, Kelley allegedly approached her vehicle.

“Kelley came running from behind the building holding three black pieces stating someone was messing with him because he found them under his truck,” the court affidavit stated. “(The woman) backed up and left the store.”

The woman called her boss and asked why he called her and he denied it, later saying that Kelley reportedly asked to borrow his cellphone. An officer checked the phone time, numbers called, and also confirmed the restraining order was still active, and then requested a warrant for Kelley to be arrested.

The next day, on the morning of Sept. 30, police found out that Kelley was going to be dropped off by his father at the Hannah Dustin park and ride and made plans to meet up with him and arrested him there.

Officers parked at the park and ride and waited for Kelley’s father to arrive. When he did, Kelley was taken into custody and held without bail.
