Penacook Man Arrested Twice in One Week

Concord Police allege that Andrew Davis burglarized Sam's Food Store on Village Street for a case of beer, other items.

A local man is facing a number of charges after run-ins with the law in September.

Andrew B. Davis, 51, of Washington Street in Penacook, was arrested at 12:40 a.m. on Sept. 12, on a felony burglary charge. The next morning, at 1:15 a.m. on Sept. 13, he was arrested again and charged with criminal trespass and default or breach of bail conditions.

According to arrest reports and court affidavits, in the first incident, officers were sent to the Sam’s Food Store on Village street for a report of a man in a dark shirt and pants breaking into the store through the front door.

A Boscawen Police officer was on a traffic stop in Boscawen when he was told by a witness that the store was burglarized so he headed to the scene to assist. When the officer arrived, he didn’t see anyone in the store but noticed a woman in the middle of Washington Street sobbing. Later, a man matching the description of the person in the store came out of a Washington Street address and ordered to stop and sit.

Another witness, an off duty security officer, was also at the scene and spoke to the Concord officer about the incident. The witness alleged that Davis was smashing the front door of the store with a shovel.

“(The witness) told me that he saw Davis enter the store, and a few moments later, exit the store with what appeared to be a case of beer,” the officer reported. “(The witness) told me that he exited his home and walked over to Washington St. where he saw Davis heading.”

After the off duty officer got there, the Boscawen officer was already with Davis.

The Concord officer went to Davis’ home and allegedly noticed a 12-pack of Bud Light, some hot dogs, pepperoni, and a block of cheese on a bench. All the items were reportedly cold to the touch and had condensation on them, as if they had been removed from a cooler.

The woman in the road was Davis’ wife. She reportedly told the officer that he had been “acting odd lately” since losing his job. She explained that he had been walking around earlier reportedly saying he was going to do “something that would make him famous and a zillionaire.” She added that he had one beer around 4 p.m. that day. After learning about the burglary, she locked the door to the apartment because she didn’t want him to come back him.

Another officer checked out surveillance video in the store and alleged that it matched Davis and he was arrested and held.

The next day, officers were called to the American Legion Post 31 on Charles Street in Penacook for a report of an unwanted person.

An employee told police that Davis was allegedly giving a member a hard time and wouldn’t leave. She stated that he was a member but the situation was “an ongoing issue and she plans on applying for a restraining order against him in the near future.”

Officers spoke to Davis, who was standing outside, and was reportedly “extremely intoxicated … swaying from front to back. (He) was wearing a T-shirt and boxers with no shoes on,” according to the report.

“I asked Andrew what was going on and he began ranting about how he owns Penacook along with this building and wanted a drink,” the report stated.

When asked how much he had already had to drink, the officer alleged that Davis stated, “Not enough.”

Since his bail conditions from the incident the morning before banned him from drinking, he was arrested and held.
