Police: Elderly Man Flashed Knife, Yelled at Neighbors

John Foote of Concord was also charged with resisting arrest, criminal threatening after incident on Conant Drive.

A local man was arrested and held without bail earlier this month after an incident with his neighbors, according to an arrest report and court affidavit.

John M. Foote, 74, of Conant Drive in Concord, was arrested at 3:55 p.m. on May 7, 2015, on felony criminal threatening (use of a deadly weapon) and resisting arrest or detention charges.

According to the reports, police were sent to Conant Drive for a criminal threatening incident involving a man with a knife.

The reporting officer spoke to the victim who alleged that his neighbor, Foote, came at him and his wife with a knife. Foote was reportedly back in his home by the time the officer arrived to investigate the incident.

The victim stated that he and his wife were working in the yard when Foote reportedly approached them while “holding a knife in front of him, extending it toward (the victim) while continuing to advance towards him,” the report stated. The man alleged that Foote then stated he would “stab” their car tires. The victim grabbed a yard edger from his landscaping tools, for protection, and told Foote to stay way.

“I asked (the victim) if he was afraid of Foote and he stated what he was,” the reporting officer alleged.

The officer had the victim talk through the incident again and also, asked him to describe the knife and how far Foote allegedly was from the couple. The officer also spoke with the woman who shared similar details about the incident.

While the reporting officer was gathering statements, another officer went to speak with Foote, who allegedly was uncooperative. The reporting officer headed over to Foote’s home to assist. The second officer stated that while trying to speak to him about the incident, he allegedly began walking toward the officer. He was told multiple times to stop and stay where he was, but Foote allegedly refused.

“(The officer) said that Foote ignored his commands and that (the officer) had to place his entire body in front of Foote and that Foote walked right past him before being taken into custody,” according to the reporting officer.

Foote was arrested and charged with resisting and criminal threatening. He was held without bail and arraigned the next day.
