CONCORD, NH — America’s Mayor is suing America’s current president in superior court in New Hampshire, accusing him of defamation and false light statements during a presidential debate in 2020.

Rudy Giuliani was in Concord on Wednesday to file a civil suit against President Joe Biden as well as five of his campaign fundraising committees in Merrimack County Superior Court, accusing the president of making defamatory remarks during the Oct. 22, 2020, second presidential debate, concerning reports about his son’s laptop published in the New York Post.

During the debate, Biden said then-President Donald Trump’s “buddy, Rudy Giuliani he (sic) is being used as a Russian pawn he (sic) is being fed information that is Russian that (sic) is not true.” Biden also pointed to there being “50 former national intelligence folks who said that what this (sic) he is accusing me of is a Russian plant. They have said that this is has (sic) all the charact . . . (sic) four five (sic) former heads of the CIA both parties (sic) say what he is saying is a bunch of garbage. Nobody believes it except the his (sic) and his good friend, Rudy Giuliani.”

Former Republican House Speaker William O’Brien, who is representing Giuliani, in the filing pointed to the “single publication rule” since the debate was broadcast in the state and was seen by about 63 million people on television as well as millions of others online.

At the time of the comments, the FBI already knew the laptop was not Russian disinformation because the department possessed a hard drive in November 2019, according to published reports. Biden also knew the comment was untrue because Antony Blinken, who was a senior campaign advisor and now works in the administration, “played the crucial role in the inception of the false letter concerning the laptop signed by 51 national intelligence officials Antony Blinken was the impetus behind its distribution,” the lawsuit said.

Giuliani said the comment had hurt his law practice, consulting business, access to online social media accounts like YouTube, and damaged his reputation. The damage, he said, cost him millions and millions of dollars.

“Being called a ‘Russian pawn’ and being called by the leading candidate of the Democratic Party, a facilitator of ‘Russian disinformation,’ is an extraordinarily damaging thing,” Giuliani said. “It may be that a lot of people don’t believe him, but a lot of people do believe him.”

O’Brien called Biden a pathological liar who was not being held accountable by the media. He said Biden had made wild claims about his upbringing. O’Brien said he had seen Democrats “through insults and lies” had attacked others due to having “no ideology.” He accused them of finding children to make political points — since they could not be criticized.

“The unfortunate thing is they can get away with it,” O’Brien said, adding the media would call him out for falsehoods and plagiarism in the past.

Giuliani and O’Brien were asked if they thought the 2020 election outcome would have been different had the FBI confirmed the Hunter Biden laptop was real and not Russian disinformation.

“You don’t have to ask me,” Giuliani said, “there are at least four or five polls that say, ‘Yes.’”

O’Brien agreed with Giuliani that “polls showed that,” but added, “It’s hard, afterward, to figure out why or how people voted.” The laptop and its information, though, would have been “so important, so much to the core of Joe Biden of who Joe Biden is, and so foreign to what Americans expect from their politicians, let alone the president, it would have turned the election.”
