Stolen Slim Jims Leads to Arrest at Hess

Kyle John Digiore, a homeless man out on bail, faces more charges.

A homeless man reportedly involved in panhandling for gas money at the Hess gas station on Hall Street and later, the willfull concealment of a popular munchie meat product, caused quite a commotion on Jan. 17.

According to a Concord Police arrest report and New Hampshire State Police, a Hess employee flagged down a passing trooper about a theft allegation at the gas station.

The trooper called in other troopers who arrived at the Burger King, next door to the Hess station, to take into custody the people allegedly involved in the incident, according to Lt. Nicole Armaganian, a spokeswoman for the department.

The state troopers had two subjects in custody when the Concord Police took over the investigation, according to Armaganian.

According to the officer's report, police were called to the scene a little past 8:30 a.m. for a theft call. The officer spoke with the Hess employee who alleged that two men and one woman had been at the station for the past few hours, allegedly panhandling for gas money. They reportedly purchased some gas but the car was having problems starting, according to the clerk.

Two men then entered the store and were “acting suspicious,” the clerk alleged. The clerk stated that one of the men, later identified as Kyle John Digiore, allegedly removed some Slim Jims, valued at about $3, from the shelf and concealed them in his coat.

The clerk reportedly confronted Digiore about the theft and asked for the items back. Digiore allegedly “became angry and very argumentative,” according to the clerk, and then removed the Slim Jims from his pocket and threw them on the store floor.

The clerk request no trespass letters for the individuals.

Digiore was served with a no trespass letter by the officer and at first, reportedly denied stealing the Slim Jims. Later, after explaining the definition of a willful concealment charge and interacting with the officer, Digiore was arrested.

The officer reported later that Digiore was currently out on bail, having been arrested on Dec. 29, 2012, by the Loudon Police Department on a criminal trespass charge. He was released from that charge on $2,000 personal recognizance bail, with an arraignment date of Feb. 11, so Digiore was also charged with contempt of bail.

Digiore, who reported no known address to police, was held on $5,000 cash bail and transported to Merrimack County Jail. He was arraigned on Jan. 18.
