The man, who had been a previous victim of domestic assault with the accused, reportedly told the officer that he went to take their son to a practice and told him first to go say “goodbye” to his mother, according to an arrest report. Abelha was reportedly sleeping at the time and allegedly “infuriated” and started yelling at him. The man stated he started fiddling with his phone, trying not to engage her, when she allegedly grabbed his phone and threw it on the floor. The officer noted that there was previous, old damage on the phone but the victim alleged that the casing was now cracked and the earpiece was not working.
The victim alleged that Abelha then threw her cellphone at him and it hit him in the head, causing a bump earlier, but the officer didn’t see it.
“He then told me that his girlfriend then started to physically attack him in the area of the living room,” the officer noted. “She was swinging her arms and striking him. He told me that during that portion of the struggle she scratched him on the neck and back.”
The officer noted that there was a scratch on the side of his neck consistent with a fingernail, according to the report. The victim also noted that he grabbed her in an effort to calm her down so that he could leave with the other children and figure out what to do.
The officer went to speak with Abelha who reportedly admitted that there was an argument because she wanted to be awake and prepared when her son left, not in bed. She alleged that the victim spit at her so she spit in his face and struck him, but it was in self-defense. When asked about the phone, she allegedly admitted to throwing it but believed she could break it, since she pays the bills.
Abelha was arrested and arraigned two days later.
In the past, Albelha has been arrested for simple assault, possession of drugs, transportation of drugs, suspended registration, and operating after suspension.
