CONCORD, NH — For the second time this summer, a complaint from a resident has led to police filing charges against a man and woman for allegedly having sex in public. At just after 11 p.m., a sergeant and an officer were sent to the Firehouse Block Parking Garage on North State Street after receiving a complaint from a person who alleged that “some sort of sexual action” was going on by the dumpsters, according to arrest reports.

“As (the sergeant) and I entered the parking garage, we both were able to hear a loud, high pitched moan,” the reporting officer alleged. “We continued to the rear floor of the parking garage where the sound was gradually getting louder.”
As they rounded the corner, they found two individuals on the ground allegedly engaged in sexual activity, according to the report. The couple reportedly didn’t realize the officers were standing there until they used their flashlights to get their attention.

“When we did, we observed the male spring to his feet and pull his pants up and attempt to button them,” the officer alleged. “He did not complete zipping his fly. The female, as well, sat up and pulled her underwear and pants up.”
Police separated the couple, interviewed them, and they both explained “a similar set of events” and were arrested.
Both Hathaway and Wicks were released on personal recognizance bail and are due in court on Sept. 26.
