Nashua Man Faces Felony Assault Charge

Warrant charging Luis Capo-Nieves with firing a gun on Ledge Street. It wasn't his first firearms violation.

Luis Capo-Nieves, 28, of 26 Ledge Street, Apt.  D, Nashua, was arrested June 13 o a warrant  charging him with attempted first degree assault, a class A felony; and breach of court ordered bail conditions, a class A misdemeanor.

The arrest warrant was issued on April 17. Capo-Nieves was arrested by Massachusetts State Police on April 18. Capo-Nieves was extradited back to New Hampshire on June 13.

On April 16, 2012 at approximately 5:39 p.m., Nashua Police received the report of a disturbance in the area of 26 Ledge Street. Uniform Patrol Officers obtained information that two males had been involved in an aggressive argument during which one of the men fired a handgun at the other. Members of the Nashua Police Department’s Criminal Investigation Division investigated this incident and identified Capo-Nieves as the suspect. An arrest warrant was obtained for his arrest. Capo-Nieves is charged with firing a .22 caliber handgun at the victim. Both men were known to each other. The victim was not injured.

At the time of this incident, Capo-Nieves had court ordered bail conditions which made it illegal for him to possess a firearm. The bail order was issued after Capo-Nieves was charged in October, 2011 with felony reckless conduct. In that incident, Capo-Nieves allegedly fired rounds into the air while in a confrontation on Central Street, Nashua.

A Class A Felony is punishable by up to 15 years imprisonment, exclusive of fines. A class A misdemeanor is punishable by up to one year imprisonment, exclusive of fines. Capo-Nieves was held at the Nashua Police Department without bail pending arraignment at 9th Circuit Nashua District Division Court.
