New Jersey Man Arrested At Airport On Nashua Rape Charge

NASHUA, NH — A man from New Jersey, who formerly lived in Nashua, was arrested in September on a felony aggravated felonious sexual assault charge after a two-year investigation.

On Sept. 18, 2021, an officer was requested to St. Joseph’s Hospital to investigate a rape allegation by a woman against a man. According to the victim, she was in her family’s apartment on Roedean Drive when Eduardo Jacinto-Neri, 23, entered her bedroom and told her “She needed to relieve some of his stress,” an affidavit said. She accused him of closing the door, attacking and striking her several times while she attempted to fight him off, covering her mouth with his hands, and raping her. Jacinto-Neri then reportedly left the apartment, she said.

The woman called her husband, who took her to the hospital.

Detectives met with Jacinto-Neri at his job at a Mexican restaurant on Amherst Street. While speaking to him through an interpreter, “he said he was already aware of the allegations being made against him” and agreed to a sexual assault examination at an area hospital, an affidavit said.

The detectives drove him to the hospital since he did not have transportation, the report said. After his examination, Jacinto-Neri agreed to speak with police and was taken to police headquarters.

Jacinto-Neri was read his Miranda rights, and during the conversation, the detective accused him of providing “inconsistent statements” but denied raping the woman. The affidavit said he claimed waking up from a knap with his pants down but did not know why. He “altered his statements” about going into the victim’s bedroom and admitted he had and wanted to relieve her stress, the report said. He was accused of admitting to kissing the woman but denied raping her.

“Eduardo said his penis might have been erect while he was doing this and that he did ejaculate inside of his shorts,” the detective wrote, “however, he remained adamant that his penis never went inside (her) vagina.”

Jacinto-Neri also claimed if his semen was found inside her, “then it meant she had probably done something to him while he was sleeping,” the affidavit said.

A detective also interviewed the victim’s husband who accused Jacinto-Neri of saying she was lying.

A second detective also interviewed the victim again. She said Jacinto-Neri came into her bedroom twice and the second time, attacked her, the affidavit said. She told the detective his semen was on a shirt and panty liner in her room, the report said.

Detectives obtained a consent search of the apartment and obtained the man’s shorts as well as the shirt and panty liner, a report said.

On Feb. 7, 2022, the state forensic laboratory confirmed sperm was inside the victim.

About a month and a half later, a detective met with the victim, to update her about the case, and when doing so, she told him Jacinto-Neri had left the state to live with family in New Jersey. She expressed concern he might try to leave the country, the report said, specifically Mexico.

In early January, the state lab confirmed Jacinto-Neri’s sperm, in two fraction samples, was inside the victim, with a 1 in 390 billion chance of error.

A warrant was issued for Jacinto-Neri on a single felony count of aggravated felonious sexual assault-domestic violence on March 3. A month later, an extraditable provision was put on the warrant.

On Sept. 23, Jacinto-Neri, who lives on Oak Tree Road in Iselin, NJ, was found at the Newark Liberty International Airport in Newark, NJ, by U.S. Customs and Border Protection agents as he was attempting to fly to Mexico City, Mexico. Detectives picked him up on Oct. 2.

Jacinto-Neri declined a Mirandized post-arrest interview, the detective said.
