Two Arrested for State Liquor Store Thefts
Marion Smith and Jessica Foye, both of Nashua, were arraigned on charges after an incident in Concord.

Two women, including one with a lengthy criminal history, were arrested recently in Concord after allegedly trying to steal more than $300 worth of liquor.
Marion L. Smith, 38, pictured right, of Mulberry Steet in Nashua, was arrested at 5:33 p.m. on Jan. 17, 2015, and charged with felony theft by unauthorized taking or transfer. Also arrested was Jessica Foye, 27, of Vine Street in Nashua, who was charged with theft.
According to two Concord Police arrest reports, officers were sent to the New Hampshire Liquor and Wine Outlet on Storrs Street for a report of a shoplifting incident. The officers arrived at the scene, approached two women they found in the parking lot, and separated them.

When asked why they were there, Foye allegedly stated she didn’t know and “denied stealing anything,” according to the report. The second officer questioned Smith and she allegedly admitted to stealing two bottles of liquor.
One of the officers went into the store and spoke to the assistant manager who stated that there had been an email alert sent out to the liquor stores warning them of two women allegedly stealing liquor from multiple stores around the state. Smith, the manager stated, also had also been issued a no trespass order two years ago, according to the report. The officer then watched the store’s security video.

“I observed Smith and Foye select alcohol bottles off the shelf and put them inside a carriage,” the officer stated. “Foye carried a large bag and I observed her select one of the bottles and conceal it in her purse. In another camera view, which was slightly obstructed by the top of the aisle, I believed Smith to also conceal some bottles in her large purse.”
According to the footage, the officer alleged that Foye walked around the registers without buying anything and then left the store by herself. Smith then walked out of the store by herself without buying anything.
The officer returned to the parking lot and arrested Smith.
The second officer asked Foye again what happened and she allegedly admitted to taking the liquor and held open her purse. In the bag, the officer alleged, were two bottles of Hennessy, a Patron Tequila, and a Ciroc Vodka, valued at about $316.
Due to her lengthy criminal history, including a felony conviction in 2005 in Hillsborough County, the charge against Smith was elevated to a felony. They were both arraigned last week.
After the arrest in Concord, Merrimack Police filed charges against Smith for a theft at that community’s liquor store, according to Merrimack NH Patch.
According to The Lowell Sun, Smith was arrested last month for a theft charge in Hudson.
In 2012, she was arrested a number of times in Nashua for shoplifting, according to Nashua NH Patch.
In 2011, Nashua Police alleged that she was trying to solicit assisted from young people to help her with criminal activity.
