18 NJ Murderers Among 148 Granted Clemency By Phil Murphy

In one of his final acts in office, Governor Phil Murphy granted clemency to nearly 150 people on Tuesday, including 18 convicted murderers.

A total of 148 New Jersey criminals were granted clemency on Murphy’s final day in office. In his eight years as New Jersey’s governor, Murphy has issued more than 450 people clemency through seven rounds, including more than 60 convicted of taking someone’s life.

On Tuesday, the former governor issued 51 commutations and 97 pardons. A pardon essentially "forgives" someone for a crime and eliminates punishment, while a commutation instead reduces the prison sentence connected to the conviction.

“Today, as I announce what will be among my final acts in office, I am reminded that our clemency initiative was never about numbers — it was about people,” said Murphy. “Each pardon and commutation represents a story of accountability, growth, and redemption…By offering second chances to individuals who have demonstrated rehabilitation and a commitment to their communities, we have strengthened not only individual lives, but our entire state. Granting clemency has been one of the greatest honors of my time as Governor and a powerful reminder that compassion, paired with accountability, helps build a stronger and more just state for all.”

Charges of those issued clemency include arson, drug possession and distribution, theft, manslaughter, and murder, to name a few.

Among those granted a pardon was Maria Montalvo, a 61-year-old woman who was convicted on two counts of felony murder in 1997.

The Monmouth County woman is currently serving a 100-year prison sentence for killing her baby daughter and toddler son in 1994, after she poured gasoline on them and burned them to death while they were strapped to their car seats.

She will now become immediately eligible for parole based on good behavior in prison.

Monmouth County Prosecutor Raymond Santiago said he was in "revulsion and disbelief" at Murphy's decision.

Montalvo joins 17 other convicted murderers who’ve received clemency, including David Moon, who was convicted of murder in 2007.

“Today, I am a man who is humbled, regretful, remorseful, and now, thankful for my freedom,” Moon told the American Civil Liberties Union. “I fully understand that if there is to be a change in my community, it must first start with me – this is my time to do the right thing and be a positive citizen and role model for others to look up to.”

Another man was convicted of vehicular manslaughter on Tuesday and was pardoned by Murphy the very same day.

Harris Jacobs, 28, of Atlantic City, struck and killed Orlando Fraga, 76, in September 2022. He was charged with leaving the scene of a fatal accident.

The following individuals were granted commutations of their prison sentences by Governor Murphy:

Mr. Barthelus will be released from prison and deported due to his immigration status.
4. Berkowitz, Mordechai: Vehicular homicide and assault by auto, sentenced in 2025. Mr. Berkowitz will remain in prison until 2028 and will be on a period of parole supervision for three years upon release.
5. Mr. Brown will be released in 2030 and will be on a period of parole supervision for five years upon release.

Mr. Johnson will be released from prison in 2029 and will be on a period of parole supervision for five years.

24. MaQbool, Tariq: Felony murder, three counts of murder, two counts of kidnapping, robbery, possession of a weapon for an unlawful purpose, and unlawful possession of a weapon, sentenced in 2005. Mr. MaQbool will be parole eligible in 2032, max-out from prison in 2047, and will be on a period of parole supervision for five years.

Marrero, Victor: Murder, conspiracy, felony murder, two counts of tampering with evidence, hindering, two counts of possession of a weapon for an unlawful purpose, and two counts of unlawful possession of a weapon, sentenced in 2009. Mr. Marrero will be immediately released from prison and will be on a period of parole supervision for five years.
26. Mazurczyk, Margaret: Manslaughter, sentenced in 2019. Ms. Mazurczyk will be immediately released from prison and will be on a period of parole supervision for five years.
27. McBride, Keith: Felony murder, robbery, conspiracy, disturbing human remains, two counts of hindering, possession of a weapon for an unlawful purpose, and unlawful possession of a weapon, sentenced in 2010. Mr. McBride will be released from prison in 2038 and will be on a period of parole supervision for five years.

Mitchell, Michael: Robbery, sentenced in 2004; robbery, two counts of conspiracy, four counts of theft, and possession of a weapon for an unlawful purpose, sentenced in 2016; robbery, sentenced in 2014. Mr. Mitchell will max-out from prison in 2038 and will be on a period of parole supervision for five years.
29. Montalvo, Maria: Two counts of murder, two counts of felony murder, and arson, sentenced in 1997. Ms. Montalvo will become immediately parole eligible.
30. Moon, David: Murder, possession of a weapon for an unlawful purpose, and unlawful possession of a weapon, sentenced in 2007. Mr. Moon will be immediately released from prison and will be on a period of parole supervision for five years.

Murphy’s final round of clemency grants came nearly two years after he signed Executive Order 362, which established New Jersey’s first-ever Clemency Advisory Board.

The board is tasked with reviewing applications for pardons, and expedites applications for certain non-violent convictions if applicants have stayed out of trouble for a significant period of time. It has reviewed more than 4,500 applications since its inception.

The board also expedites applications for those serving sentences that do not reflect the severity of their crime, and victims of abuse who are in prison for committing a crime against their perpetrator.

The goal of the Clemency Advisory Board is to “provide relief from inequities that have existed and been perpetuated in the criminal legal system.”

“I owe deep gratitude to the members of our Clemency Advisory Board who have been working around-the-clock to thoroughly screen and review each applicant's case, ensuring they meet the criteria of Executive Order No. 362,” Murphy said. “Together, we are creating opportunities for those who have made mistakes in the past to heal, and ultimately, contribute to our shared future.”

Newly sworn-in Governor Mikie Sherrill has not spoken much on her clemency plans, but the Clemency Advisory Board remains listed on the governor’s official website.
