Beachfront Homeowners Win, Long Beach Township, State Lose

Judge rules seven Loveladies homeowners must be compensated for illegal temporary taking of properties for storm protection project.

Long Beach Township and the state Department of Environmental Protection erred when they used the Disaster Control Act to temporarily take seven oceanfront properties for beach replenishment work, according to nj.com

Ocean County Superior Court Assignment Judge Marlene Lynch Ford ruled recently that the property owners must be compensated for the six months before the acquisition was voided.

“No matter how laudable the government’s objectives of shore protection are, they must comply with their constitutional obligation to pay just compensation where constitutionally protected properties are implicated,” Ford wrote in her decision.

Details about how much will have to be paid and who will pay it are still being calculated. That includes fair market value and interest, and a pro-rated share of taxes and attorney’s fees.
