Former Brick Councilman Charged With Sexual Contact With Boy, 15

Toth, who served on the council from 2005-2013, was seeking re-election to the council this year.

Dan Toth, a former Brick Township Councilman who had been seeking to return to the council in this year’s election, has been arrested on charges of criminal sexual contact with a 15-year-old male, the Ocean County Prosecutor’s Office has confirmed.

Toth, 38, was arrested Monday by members of the prosecutor’s office’s Special Victims Unit Detective Melissa Matthews and Jackson Township Detective Edward Howe, Al Della Fave, spokesman for the prosecutor’s office said.

Della Fave said the arrest was the result of an investigation initiated after the teen boy reported the alleged incident to Jackson police.

Toth voluntarily responded Monday to Jackson Police Headquarters, Della Fave said. Following an investigation by the partnering agencies, with the assistance of the Ocean County High Tech Crime Unit, Assistant Prosecutor Christine Lento approved charges of criminal sexual contact pursuant to N.J.S.A. 2C:14-3 and endangering the welfare of a child pursuant to N.J.S.A. 2C: 24-4a, he said.

According to the arrest warrant, Toth rubbed the boy’s genitals.

Superior Court Judge Rochelle Gizinski set bail at $100,000 with no 10 percent option. Nicole’s Law (no victim contact) has been implemented and the Division of Child Protection and Permanency was notified, Della Fave said.

Toth, who has posted bail, is seeking re-election to the Brick Township Council after spending the last two years on the sidelines. Toth had served on the council from 2005 to 2013, when he stepped down to run for mayor. Toth lost in the Republican primary to Joseph Sangiovanni, who later lost to current Brick Mayor John Ducey.
