No Jail Time For Man Who Snapchatted Assault On Brick Woman

Zachary Madle pleaded guilty in January to invasion of privacy, for recording a sex act without consent, according to court records.

MAYS LANDING, NJ — An Atlantic County man has been sentenced to five years' probation for his guilty plea where he admitted posting videos of himself touching the genitals of a Brick Township woman on Snapchat in 2017.

Zachary Madle, 26, of North Wildwood, was sentenced by Judge Bernard E. DeLury Jr. on Feb. 13 on a charge of invasion of privacy for recording a sex act without consent, according to state court records. He had pleaded guilty to the charge in January, after he was denied entry into the pretrial intervention program, according to court records.

DeLury said the probation sentence was the maximum he could give because Madle did not have criminal charges in his past, NJ.com reported.

Madle was arrested in April 2018 on a charge of invasion of privacy by recording a sex act without consent, but it wasn't until the woman filed a federal lawsuit against Stockton University and Madle in July 2018 that details surfaced.

Madle was indicted in September 2018 by an Atlantic County grand jury on two counts of invasion of privacy and one count of aggravated criminal sexual contact.

The woman was a freshman at Stockton at the time of the Feb. 15, 2017 incident that happened in her dorm room. Her last memory before blacking out is of kissing Madle, according to the lawsuit. She woke up naked, confused and covered in vomit the next morning, and discovered three videos on Snapchat showing Madle sexually assaulting her while she was unconscious, according to the lawsuit and the criminal complaint filed against Madle.

The woman told the court and Madle at his sentencing that she has changed her appearance drastically "so I wouldn’t look like the girl in the video he so heinously posted," the NJ.com report said. "You and I both know you raped me that night, you just didn’t post it to your Snapchat story."

The woman's lawsuit was one of three filed against Madle and one of nine filed against Stockton, and a fraternity, Pi Kappa Phi, alleging they did not protect women from sexual assaults.

Robert Fuggi, the attorney who represented the women, said the lawsuits have been settled.

"Although we have confidentiality agreements as to the contents and amounts of the settlements , the brave woman victims are pleased that their voices and concerns were brought forth publicly through this litigation," Fuggi said in an email. "They are hopeful Stockton University has implemented necessary changes in policy to protect the health safety and welfare of future students, so these unfortunate events do not happen to other women students while attending Stockton University."
