Council Set to Vote on TMB Agreement
Township Council will vote tonight on a resolution on a settlement with TMB Partners in the affordable housing case.

Livingston's Township Council is set to vote tonight on a litigation settlement agreement with TMB Partners in the ongoing affordable housing case.
TMB Partners have proposed plans to construct a housing complex with affordable housing units on its property at the corner of South Orange Avenue and White Oak Ridge Road, where Tutor Time currently is located.
Livingston and TMB Partner had previously reached an agreement on the project, but the terms of that accord were not implemented as nearby property owners — in particular, members of the Livingston- Short Hills Coalition — questioned the environmental impact of the development of the site, as did Millburn Township, which borders the site.

The issue has been going back in forth between the townships, TMB Partners and judges reviewing the case for several months now. But according to the resolution for the settlement outlined in tonight's township council agenda, it appears that Livingston is willing to move forward with an agreement with TMB Partners.
According to the terms outlined in the draft agreement of the resolution to be voted on tonight, officials in Livingston Township have decided "that it is in the best interest of the public good and welfare to settle all claims asserted by TMB in the Consolidated Litigation upon the terms and conditions contained herein so as to advance affordable housing purposes and objectives in a manner consistent with sound land use planning principles."

The intent of the agreement, as the draft outlines, is to permit TMB to construct a maximum of 62 multifamily units, including 12 rental units affordable to low and moderate income households consistent with COAH guidelines (New Jersey Council on Affordable Housing).
