Millburn Still Weighing TMB Options
Millburn Township committee hasn't discussed how it will proceed with Livingston's decision to settle in the case.

Millburn Township officials have yet to decide how they will proceed following Livingston's recent decision to settle with the developer planning to build affordable housing on the Short Hills border.
During the last Township Committee meeting on Aug. 17, Mayor Thomas McDermott said local officials have made no commitments on supporting the settlement agreement for the case between Livingston and TMB Partners. The committee was to discuss their options during an executive session following the public session.
The agreement would allow TMB to develop 62 multi-family units, which will have 12 units available to rent for low and moderate income households, at the corner of White Oak Ridge Road and South Orange Avenue at the corner Tutor Time site. The original plans called for the building height to be 75 feet, but it will be limited to 55 under the new settlement.

McDermott said on Wednesday the committee came to no conclusions during the executive session, but members asked questions for the attorney. Those answers have yet to be discussed, he said.
With Millburn Township Committee members on vacation this summer, there hasn't been time for there to be a discussion, McDermott said. But "there is some time" before officials need to make a decision, he said.

The fairness hearing for the court to accept the agreement is scheduled for mid-September, he said. Then the Planning Board would need to review the proposal, he said, which is when the finer details would be discussed and debated.
