Eruv Markers Vandalized, Mahwah Police Launch Bias Crime Investigation
The markers have been at the center of controversy since the township told a Jewish organization they had to remove them.

MAHWAH, NJ — Township police are investigating damage to eruv markers in the township that have been at the center of controversy since the township told a Jewish organization they are illegal and have to be removed.
The markers are PVC pipes the South Monsey Eruv Fund of Spring Valley, New York installed on utility poles in town.
Eruvs symbolically extend the private domain of Jewish households into public areas. Jewish households within an eruv are allowed to participate in activities that are normally banned on the Sabbath.

Chief James Batelli said there have been acts of criminal mischief and damage to the markers in four locations. Authorities are reviewing surveillance video as part of the investigation. The Bergen County Prosecutor's Office has been notified of the damage.

The matter is being investigated as a hate or bias crime because the crime targeted a class of people based on their religion or ethnicity.
Anyone convicted of a hate or bias crime is subject to enhanced criminal penalties.

Town zoning officer Michael Kelly sent a letter to the Monsey Eruv Fund demanding the markers be removed because they violate a township ordinance. Removing them must begin by Friday and they must be completely removed by Aug. 4. Summonses may be issued if the markers are not removed.
Hundreds of residents recently met to find out ways of removing the markers from the township.
