October 14, 2021

The EEOC has updated guidance on October 13, 2021 employer vaccinations.  The availability of COVID-19 vaccinations raises questions under the federal equal employment opportunity (EEO) laws, including the Americans with Disabilities Act (ADA), the Rehabilitation Act, the Genetic Information Nondiscrimination Act (GINA), and Title VII of the Civil Rights Act, as amended, inter alia, by the Pregnancy Discrimination Act (Title VII) (see also Section J, EEO rights relating to pregnancy).

This section was originally issued on December 16, 2020, and was updated on October 13, 2021.  Note that the Centers for Disease Control and Prevention (CDC) has issued guidance for fully vaccinated individuals that addresses, among other things, when they need to wear a mask indoors.
