Stop & Shop Ends 24-Year Legal Battle With Millburn: Officials

MILLBURN, NJ — A decades-long court battle between Millburn municipal officials and Stop & Shop may have ended with a victory for the township.
Millburn Township Business Administrator Alexander McDonald recently announced that the 24-year legal fight between the grocery chain and Millburn Township and its Board of Adjustments - ended with a dismissal before a pending trial commenced, TAP Into Millburn/Short Hills reported.
As a result, the denial of Stop & Shop's application by the Millburn Board of Adjustment will remain intact, town officials stated in a news release.

Stop & Shop had wanted to build a new Springfield/Millburn location at a vacant property along Millburn Avenue. Springfield had given the new store a thumbs-up, but plans snagged in Millburn, where officials expressed concerns about possible issues such as increased traffic.
During a 2012 meeting of the Millburn Zoning Board, Stop & Shop's traffic engineer testified that 6,150 cars would come to the supermarket each weekday. That would mean 61,500 vehicle movements entering and exiting the site from Millburn Avenue just during the week. Also, the traffic engineer said that there will be up to 180 tractor trailers and vendor trucks entering and exiting on Millburn Avenue Monday through Saturday.
