Fired Morris School District Custodians Sue for Wrongful Termination
Part-time janitor let go in 2012 after allegedly using girls bathroom when student was present, report says.

A former janitor for the Morris School District and a colleague who went to bat for him were both fired in 2012, and have now filed suit against their former employers for wrongful termination.
According to dailyrecord.com, part-time custodian Daniel Seaberg and maintenance worker Thomas Bender have filed suit in Superior Court, Morristown.
Seaberg, considered a disabled person because of his assignment to special education classes as a student, was fired in Oct. 2012 after he allegedly used the girls bathroom at Thomas Jefferson Middle School the prior month when an 8-year-old student was present, the report said.

Seaberg’s colleague, Bender, voiced concerns about the investigation and termination of the part-timer’s job, and was subsequently released from his duties after nine years on the job, the report said.
An original police report stemming from the incident stated Seaberg never admitted to entering the girls bathroom, contending he used a urinal in the boys bathroom during a quick break from working outdoors, the report said. No charges were filed, and police recommendation was for the matter to be handled administratively, the report said.

The suit seeks compensatory and punitive damages.
