Done Deal Planning Board Goes Through Motions of Submittal to Private Agreement Ordinance 2015-26 Subverts Master Plan

Sad Day for Mother Earth. RD trumps Parsippany Citizens, It's own Master Plan, Politicians. Apparently it was a dream, No vote October 2014.

Advantage dismissed first step in betraying Council No Vote October 2014

Starting with Parsippany's withdrawal from regional conformance in June 2015 all great advantages were lost; the open space could of been accomplished by Home-Rule, but with "conformance" legal protections would have been enforced. To exchange a POD zone for unneeded retail commercial and paying over $3.5 million for a buffer/open space is a rip-off. In the end the Board & mayor acted like RD was Parsippany friend. Public Housing is still an obligation, and if this situation was properly handled waterview would never have been developed at all. In fact beginning in September 2009 Parsippany rather than enlighten and inform its citizens on regional conformance kept it in the closet. Their initial intention was avoiding public housing, or so they thought. Ah; bit alas it could have been avoided in waterview's case, as environmentally sensitive lands cannot be developed, and land pending or in open space status cannot be so developed. Parsippany's reasoning for going in to conformance and then getting out when it would of benefited them most, especially in waterview's case, make no sense, other than fear of public housing had to be used to justify RD proposals; as they themselves used public housing as their tactic. Parsippany rather than see this as a false flag played along with RD against the entrusted community.

The Council No Vote of October 2014 has been forgotten and ignored. Grassroots democracy in Parsippany does not work.

Ordinance 2015-26 subverted our entire master plan

Inglesino's 2015-26 Ordinance establishing the retail commercial zone was a sleazy legal deal; against everything the citizens accomplished. This was their intention from day one. In my opinion Mayor Barberio has betrayed his community for the private interest. Inglesion's law firm could well have appealed represented the No Vote, by using our Master Plan and under regional conformance the chances were even better. He, Mike dePierro and Barberio have been outspoken against regional conformance, for all the wrong and misguided reasons. In this case we see clearly again, not home rule ,but RD rules, and RD does not even own the property. Using fear of public housing is now costing tax payers another lawsuit; which is great for Inglesion's law firm.

We must thank Governor Christie for screwing up the COAH formulas. Any Governor who demises Highlands & Pinelands legislation is no friend of the people of NJ. Parsippany's closed mind to Highlands Benefits of long term sustainability and balanced land planning shows their priorities are not centered in their communities best interest, but in their own "pretended powers" and denial of what is possible. We are in the planning area, so what is to fear? The key is protecting remaining natural resources and especially our water.

Home Rule; Who rules?

Home Rule is developers rule. Shall we all feel good because we helped RD developer overcome their hardship, that is Parsippany's home rule. The Mayors promise of open space after the council no vote, also shows his self interest over the community, now he simply states without actual proof that this is better for everyone. All based on public housing unfounded fears. We lost a landscape changed a neighborhood; POD to RC Zoning and still have the housing obligation, or do we? Perhaps it was a hoax that worked as planned. We have made it easier now for FSHC to sue and possibly win a lawsuit. Waterview landscape is certainly now more vulnerable to housing for public good and need is housing not retail commercial.

This new retail commercial Waterview Market Place without any evidence of need, will invite more retail which is on the decline in order to compete and demise already existing retail in the area. The hoax being promoted is that somehow this has saved Parsippany from a real or imaginary public housing obligation. All of a sudden RD developer is Parsippany's best friend, is it because we are codefendants in a lawsuit being brought by Fair Share Housing Council? Why because Parsippany and RD used fear of public housing to advance RD unneeded development, which now rightly so is suing both. Waterview unique landscape and its natural resources will never again be part of us. This landscape was already working for Parsippany in the highest of all senses, protecting our water supply, providing aesthetic beauty and character. Rather than enforce and have our master plan develop our future as written, this administration has allowed an ordinance 2015-26 to settle a lawsuit in closed session which subverts our whole Master Plan and betrays the No Rezone vote of October 2014. HSG A soils the best nature has to offer, steep slopes and a forest will be lost forever. No engineering of stormwater can match the once existing natural processes all provided for free by nature.

What hurts the most though is the phony after game remarks that this is good for everybody, somehow the hundreds of people who filled the school auditoriums were just some passing fade and would eventually just fade away. Good Citizens don't count, they just fade away.

This past February 2016 Mayor Barberio received a recognition award from NAIOP a commercial real estate development association; for his so-called bold and innovative methods of promoting economic growth and change in the community. Would not it be bold and innovative to support and enforce his own Master Plan and or enforce his community's quality of life through regional planning rather than capitulate to developers to the point of extremes?

Not Proud of Parsippany. Parsippany is whatever some developer wants it to be. Its no wonder Parsippany does not celebrate Earth Day.
