R2014-102 Based on individual discretion of Town attorney not objective facts or truth in regional conformance

We are being denied the right to belong to Regional Planning of the New Jersey Highlands water protection Planning Act!

Resolution 2014-102 Catching Up to Parsippany. Arbitrary and Capricious Attorney Denies Citizens Right to better planning and community.

Why did Parsippany scape Regional Master Plan Conformance in 2014 under the NJ Highlands Water Protection & Planning Act? Reading the resolution, 2014-102 passed in June of that year, is positive proof of the Barberio/Inglesino arbitrary and capricious mindset toward good land use, and Parsippany's own alleged master plan goals and objectives. None of the reasons nor allegations listed and opinionated in the resolution have any validity, they must simply be accepted without discussion, transparency or any due diligence in official or public investigation or fact based conclusions. The resolution short circuited any public input nor encourage any debate into its positive or negative results. The 2014-102 is merely based and stated on John Inglesino individual and slighted judgement against the Highlands water protection and Planning Act. It is not based on any objective distinction, but uses random assumptions that the Act will do such and such and result in such and such. A+B=C. The hidden fact kept from the public never allowed a debate or education process in why regional planning would result in more home rule and less dominance by developers in Parsippany was taboo and not allowed.
Parsippany entered the Conformance in 2010, but under Barberio did nothing to strengthen its master plan or better its community; for example using it to help obtain Forge Pond, or Waterview's Doremus Ridge. Most likely Parsippany stayed in Conformance until June 2014 because of the fact that under regional conformance affordable housing numbers are lower using science in landuse capability and environmental sensitivity factors inherent in the land itself. Using the Skyview pumping station breakdown as an excuse to end conformance which is questionable and false R2014-102 sites other numerous allegations against conformance claiming it would impede and prevent other development proposals.

Better Planning or just deals? Short term jobs accumulative land destruction and abandonment.

Parsippany is 100% in the planning area, so why or how could these project and so-called redevelopment projects be impeded by conformance? redevelopment is encouraged in the planning area. Under what pretext would Highlands prevent or obstruct a needed repair on a sewage pump facility? If Parsippany had not moved forward in the conformance process how could it impede any of alleged claims in R2014-102? The Skyview pumping station was used arbitrarily and capriciously to end conformance. However the affordable housing issue which was being used as a fear tactic to favor other developments not needed or wanted, like Waterview was still pending. So when conformance would really matter and as promoted by the housing fear tactics used, Parsippany terminated its status. One would think the Planning Zone would be better if better planned in a wholesome sense not developers plans..

Developers and Inglesino then alleged our housing numbers would be in excess of 3000 perhaps more at the very least 1500 units. The number under conformance is 807 units. The following from R2014-102:
WHEREAS, the Township will continue to study incorporating the applicable goals and
objectives of the Highlands Regional Master Plan into the Township Master Plan where they are determined to be on balance with the need to further targeted economic improvement and redevelopment opportunities of the Township.
Lesser Housing Numbers are possible
Simple if the number in 807 under conformance and it is, isn't time we determined it is time to conform, and save our town from a developers onslaught; or has Parsippany decided to become the dumping ground or transfer zone for regional housing? this is the very acquisition leveled at the Highlands Act by this administration! .own attorney Inglesino alleges that under Highlands the numbers would not be lower, this is false. He also falsely insists, no agreement between affordable housing and Highlands is in effect. That the MOU of 2008 between Highlands & Fair Share Housing exists. It does it's called the Skillman decision. This understanding assures environmental factors of the water protections are upheld, which using land capability science shows Parsippany's build out number at 807. We do need to clean up Parsippany, and we need to education our citizens to the benefits of Regional Planning . We live in the Highlands of New Jersey and Parsippany is in the Planning Zone. Councilman dePierro states he does not want Highlands telling Parsippany how to run its town. He would rather have developers like RD do it, like at waterview, where a No Rezone Vote and a open space promise were evaporated.

Waterview Buffer Called Open space $3.6 Million to Rd developer

Finally have a NJ Highlands Council interactive map that clearly shows that the $3.6 Million is going for the "riparian zone" that would under normal circumstances be a mandatory buffer for the Troy Brook/Floodplain in the area. It's a direct replication of the so-called open space.What values is this open space in a legitimate open space system of payment and acquisition? Why pay for such a land remnant if it can be gotten otherwise?

The steep slopes of Doremus Ridge would of prevented any public housing, as would the open space promise Barberio made after the council No vote.. Parsippany would rather pay Inglesino bills than have legal protections under conformance, and have developers dictate to Parsippany, than science and good land use under Highlands water protection and planning act. Their number for affordable units is 807 based on land use capability and environmentally sensitive land protections.

Ratable chase does not work for homeowners

As far as Parsippany needing "another" tax-ratable; how are these developments/land destruction failures helping the homeowner? Taxes for me just went up again $202.24. No ratable go to the BOE, but with the double talk of politics BOE is a separate realm somehow; remembering the artificial turf fiasco and Parsippany's BOE finding over $2million dollars in their budget after Barberio's Field of Dreams was voted down, somehow this money no longer belonged to taxpayers. (Field of Dreams was an attempt to improperly use local open space funds for the turf). Being taxed for education is one thing; paying for artificial turf and sport fanatics is something else; especially for retired, older folks on set incomes.
We must also not forget the NJ State Lottery was suppose to raise funds for property tax relief by funding education; what happened to that? Tax ratable on commercial industrial properties don't work, and over time are depreciated. When they fail courts give tax relief, residents end up paying in the quality of living and increased taxes for wear and tear on local infrastructure. Now we have Waterview Market Place, how nice, but for how long and what need actually existed in the community itself? What change occurred in the immediate neighborhood or area to justify this fantasy world? Take a drive around and see all the empty building, offices, malls structures, and the for sale signs for more land destruction. we are doing ourselves in for short term jobs that are destroying our natural resources, and especially water.
When saluting the flag or saying god blesses America, what is America if not the land and the people entrusted to be its guardians. Land is foremost a natural resource and gift of creation. We are doing ourselves in, and destroying this planet. Without regional Plan Conformance this cannibalism of land as a commodity will surely impede and destroy any future worth having. Are our Town Councilman and Mayor ignorant of the costs of commercial developments and the futility of the ratable chase; or are they just into making private deals, pell-mell as the developers line up?

No doubt our present administration are climate deniers and water comes in a plastic bottle. What is worse science is only alternative facts or water & oil mix; no problem? Anything to make a buck.
