PLEASE TAKE NOTICE that the Township of Teaneck Zoning Board of Adjustment (the “Board”) will hold a virtual public hearing at a special meeting of the Board on October 28, 2020, at 7:00 PM, to review and take formal action upon an application for preliminary and final major site plan approval along with use variance, bulk variance and design waiver/exception relief (the “Application”) by 189 The Plaza LLC (the “Applicant”) with respect to properties having street addresses of 174 & 168 State Street and 189 The Plaza, Teaneck, New Jersey 07666 and being designated as Block 5005, Lots 1, 2 & 11, respectively, on the Township of Teaneck Tax Map (the “Property”). The Property is located in the B-1 Zone.

The Applicant seeks approval to construct a six- (6) story residential building that includes 48 residential units spanning four (4) stories over two (2) stories of structured parking. The Applicant proposes related site improvements, including, but not limited to, landscaping, lighting, parking and drainage. The Applicant also proposes interior and exterior amenity space. The Applicant seeks a use variance pursuant to N.J.S.A. 40:55D-70(d)(1) for a proposed exclusively residential building where same is not permitted. The Applicant also seeks a height variance pursuant to N.J.S.A. 40:55D-70(d)(6) for building height greater than permitted (35 ft. permitted; 70 ft. to roof proposed; 73 ft. to parapet proposed; 80 ft. to bulkhead proposed).

Additionally, the Applicant seeks bulk variance and design waiver/exception relief as follows:

(1) Rear yard setback less than required (20 ft. setback required; 0 ft. setback proposed);

(2) Building coverage greater than permitted (25% permitted as determined by Township of Teaneck Zoning Officer; 80% permitted per Applicant’s interpretation; 97% proposed);

(3) Lot coverage greater than permitted (80% permitted as determined by Township of Teaneck Zoning Officer; 100% permitted per Applicant’s interpretation; 97% proposed) (if deemed necessary);

(4) Height of bulkhead greater than permitted (12 ft. above building height permitted; 8 ft. above 35 ft. permitted; 10 ft. above proposed building height and 45 ft. above 35 ft. proposed) (if deemed necessary);

(5) Number of ingress/egress points less than required (2 ingress/egress points required; 1 ingress/egress point proposed) (if deemed necessary);

(6) Lighting levels greater than permitted (if deemed necessary);

(7) Front yard setback less than required (2 ft. setback from State Street required; 8 ft. setback from The Plaza required; 0 ft. setback from both State Street and The Plaza proposed) (if deemed necessary);

(8) Parking stall width less than required (9 ft. width required; 8 ft. 4 in. width proposed) (if deemed necessary);

(9) Parking stall length less than required (18 ft. required; 17.5 ft. proposed) (if deemed necessary);

(10) Drive aisle width less than required (24 ft. required; 23.5 ft. proposed) (if deemed necessary).

The Applicant also seeks any additional deviations, exceptions, design waivers, submission waivers, use variances, variances, de minimis exceptions from the Residential Site Improvement Standards, interpretations, continuations of any pre-existing non-conforming conditions, modifications of prior imposed conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and as may be determined to be necessary during the review and processing of the Application.

Pursuant to the declarations by the Governor of the State of New Jersey [Executive Orders 103 and 107], and the mechanisms that have been used by local governments during emergencies that render in-person meetings less than optimal, the public hearing will be held by online/virtual means and telephonically only. During the public hearing, any interested party will have an opportunity to listen to and, if participating online, view the hearing in its entirety, be heard (ask questions, provide comments or offer evidence) by either (a) participating online by visiting https://us02web.zoom.us/j/98557541767 and following the instructions provided to join the online/virtual meeting, including but not limited to entering meeting ID: 985 5754 1767 and passcode: 074178 or (b) participating telephonically by calling +1 (929) 205-6099 or +1 (301) 715-8592 and entering meeting ID: 985 5754 1767 and passcode: 074178. Participating via online/virtual means or telephonically is free of charge to the public.

Members of the public interested in participating in the public hearing on the Application can advise the Board Secretary, Rosiland McLean, of their interest in participating in advance of the public hearing by sending an email to the Board Secretary at rmclean@teanecknj.gov or by calling the Board Secretary during regular business hours at (201) 837-1600 ext. 1110. In addition, if any member of the public has a concern regarding utilizing the technology set forth above to participate in the public hearing, the member of the public may contact the Board Secretary by email to rmclean@teanecknj.gov or by phone at (201) 837-1600 ext. 1110 during regular business hours. There will also be a portion of the public hearing dedicated to public questions, public comment, and the opportunity for the public to offer evidence.

The Application and supporting materials (including maps and plans) will be available for public inspection at least 10 days prior to the public hearing at the office of the Board located at the Township of Teaneck Municipal Building, 818 Teaneck Road, Teaneck, New Jersey, during regular business hours, which are typically Monday through Friday, 8:00 AM – 5:15 PM. Alternatively, members of the public may contact the Board Secretary at (201) 837-1600 ext. 1110 during regular business hours or email the Board Secretary’s office at rmclean@teanecknj.gov in order to request copies of the Application materials, plans, and related documents be sent to them by email. The public hearing may be continued without further notice on such additional or other dates as the Board may determine.
