Indicted Politicians Suspended Under Proposed Bill

Assembly Republican Deputy Whip Nancy F. Muñoz introduced legislation that would suspend any indicted member of the Legislature from their office, including their salary and other benefits, until they are either convicted or exonerated of the charges.

If a member of the Legislature is ultimately convicted, resulting in a forfeiture of office, any loss of salary and benefits would date back to the time of suspension. If a member is exonerated or if the indictment is dismissed, the member would be entitled to back-pay and reinstatement of all other benefits from the date of the suspension.

“It is difficult for a legislator to fulfill their primary responsibility of representing the interests of their constituents while under indictment,” said Muñoz, R- Union, Morris and Somerset. “Until the charge is resolved, it is in the best interests of the affected constituency that a temporary replacement be assigned. Good government is best achieved when legislators are focused on serving the needs of those who elected them to office."

Under Muñoz’ bill, A-3732, the leader of the respective political party in the Senate or Assembly that is affected by the indictment will name a temporary replacement until the matter is resolved.
